PART I

Applicability & Key Definitions

RULE 2

Application of Rules

  • These rules apply to Government servants to whom the Central Civil Services (Pension) Rules, 2021 apply.
  • 📋NPS employees (CCS NPS Rules 2021): Benefits of family pension, disability pension and constant attendant allowance are payable IF the Government servant had exercised an option to this effect under Rule 10 of CCS (NPS) Rules, 2021 — triggered only on death or discharge due to disability.
  • 🚫Excluded: No benefits under these rules for a Govt. servant who dies or gets disabled while on foreign service under a UN body, if the employee had opted NOT to pay pension contributions during the deputation and not to count that service as qualifying service (per Rule 29, CCS Pension Rules, 2021).
♿ Divyaang / Disability — Section 20, Rights of Persons with Disabilities Act, 2016
  • ▪️Where Section 20 of RPDA 2016 applies, the case is governed by that section first.
  • ▪️If a Govt. servant covered under Sec. 20 wants to retire and claim benefits, they must be advised of their option to continue in service with same pay and benefits.
  • ▪️If they still proceed with retirement, their disability pension case is processed under these rules.
  • ▪️Establishments exempted from Sec. 20 (by notification under Sec. 20(1) proviso) — employees boarded out are eligible for disability pension under these rules. If fit for less laborious duty, they may be employed on a lower post (subject to willingness); if not willing or no lower post, disability pension is granted.
  • ▪️If such an employee is retained in service despite disablement, lump-sum compensation in lieu of disability element is paid [per Rule 10(5)].
RULE 3

Key Definitions

AccidentA sudden and unavoidable mishap; OR a mishap due to an act of devotion to duty performed in an emergent situation arising in course of service or otherwise. Does NOT include an incident of violence.
ViolenceAn act by a person/persons to inflict injury on a Govt. servant by assaulting/obstructing/deterring/preventing him in discharge of duties — (i) by virtue of anything done/attempted by such Govt. servant or any other public servant in lawful discharge of duty; or (ii) by virtue of his official position. Also includes injury as a collateral victim due to presence at place of incident in connection with official duty.
DisabilityA condition resulting in long-term physical, mental, intellectual or sensory impairment which, in interaction with barriers, hinders full and effective participation in society equally with others.
DiseaseIncludes a disease as mentioned in Schedule-I.
InjuryIncludes an injury as mentioned in Schedule-II.
PayBasic pay (as per FR 9(21)(a)(i)) the Govt. servant was receiving immediately before retirement or death; or on date of injury/disease in case of retention in service. Also includes: stagnation increment and non-practising allowance granted to a medical officer in lieu of private practice.

PART II

Grant Conditions, Authority & Categories

RULE 4

Conditions for Grant of Disability Pension or Family Pension

A disability pension or family pension shall be granted only if there is a causal connection between:

For Disability Pension
Disablement ↔ Govt. Service

The disablement must be certified as due to wound, injury or disease: (a) attributable to Govt. service; OR (b) existing before or arising during service and aggravated thereby.

B
For Family Pension
Death ↔ Govt. Service

Death must be certified as caused due to or hastened by: (a) wound, injury or disease attributable to service; OR (b) aggravation of a pre-existing condition attributable to service.

  • 📝No application required: It shall NOT be necessary for the Govt. servant or the family to submit any application for grant of these pensions under these rules.
  • 🏢Head of Office responsibility: Must consider each case of death or disability and submit to competent authority within 3 months of receipt of Medical Board report. Claim shall NOT be rejected due to delay on the part of HoO.
  • 💡Disability pension consists of a service element + disability element (determined per Rule 10).
  • 📌On death of a disability pensioner, family pension is payable per Rule 11(2).
RULE 5

Authority for Grant of Disability / Family Pension

  • 🏛️Power is exercised by the Secretary of that Ministry/Department OR any officer not below the rank of Joint Secretary (to GoI) to whom this power is delegated, in consultation with the Financial Adviser.
  • 🔽The Secretary may further delegate to an officer not below the rank of Joint Secretary of the concerned organisation/office (with Financial Adviser concurrence).
  • 📋Each case must be examined per guidelines in Schedule IV.
  • The authority must satisfy itself that conditions in Rule 4 are met and certify causal connection between disablement/death and Govt. service.
⚠️ Note 1 — Schedule IV Guidelines

Schedule IV guidelines aim to determine attributability of disablement or death to service. If a case is NOT strictly covered by Schedule IV guidelines but the authority is of the opinion that disablement/death is otherwise attributable to service, it may record reasons in writing and still grant the pension.

⚠️ Note 2 — No Medical Report Secured

If a Govt. servant died in circumstances where a medical report could not be secured, the competent authority may award family pension under these rules if otherwise satisfied of the causal connection.

RULE 6

Other Conditions

  • 🚫Where pension/family pension/gratuity under these rules is granted for a period of service, no pension/family pension/gratuity under any other rules shall be payable for the said period during the currency of the grant.
  • 🔒The disability element of disability pension shall NOT be taken into account in fixing pay on re-employment in Govt. service.
RULE 9

Attributable to / Aggravated by Govt. Service

Diseases from continued exposure to hostile environment or occupational hazards/extreme weather; accidents while on duty (not covered in C or D). Disability element = 30% of emoluments for 100% disability.

C

Acts of Violence / Riots / Specific Hazardous Ops

Violence by terrorists in public places (non-targeted); attack by fellow Govt. servant; riots; fire-fighting operations; test flights of aircraft. Family pension = 100% of pay; Disability element = 30%.

Attack targeted against the Govt. servant by terrorists; action against extremists; enemy action/war/border skirmishes; evacuation from war-torn country; kidnapping by extremists; live-ammunition training. Disability element = 100% of emoluments; Family pension = 100% of pay.

PART III

Disability Assessment & Medical Board

RULE 7

Determination of Percentage of Disability

  • 🩺Percentage of disability due to any disease (Schedule I) → as certified by the Medical Board
  • 🦴Percentage of disability due to any injury (Schedule II) → as specified in Schedule II, or failing that, as certified by the Medical Board

⚠️ Important Exception

The above broad-banding shall NOT be applicable to Govt. servants who are retained in service despite disablement (they receive lump-sum compensation instead, calculated on actual % disability).

RULE 8

Medical Board Findings & Appeal Process

Findings Communicated

Findings of examining Medical Board must be made known to the Govt. servant or family within one month of receipt of the medical report by the Head of Office.

Filing an Appeal

If the Govt. servant wants to appeal, he must do so with requisite evidence within one month from the date findings were communicated. Head of Office may allow spouse or eligible family member to appeal if the Govt. servant is incapacitated.

Medical Certificate as Evidence

A medical certificate produced by Govt. servant/family shall NOT be considered unless it contains a note by the practitioner that it was given in full knowledge of the previous Medical Board's findings.

Review Medical Board

If appeal is supported by such a certificate → Review Medical Board constituted by the competent authority (Rule 5). If not supported by such certificate → first referred to DGHS, Ministry of Health to advise on whether there is an error of judgment.

Final Decision

Review Medical Board shall NOT include any member from the original Board. Findings of Review Medical Board are binding on all parties. The extent of disability so determined is final — Govt. servant NOT required to appear periodically to certify continuance of disability.


PART IV

Amounts Payable — Disability Pension & Family Pension

✅ Additional Quantum for Senior Pensioners

The additional quantum of pension admissible to pensioners aged 80 years and above (under Rule 44(6) of CCS Pension Rules 2021) is also admissible on the disability pension granted under these rules.

RULE 10(5)

Lump-Sum Compensation — When Retained in Service Despite Disability

  • 💰If a Govt. servant is retained in service despite disablement, he is paid a lump-sum compensation in lieu of the disability element of disability pension.
  • 📐The lump-sum is calculated by capitalising the disability element with reference to the commutation table in force at the time.
  • 🚫Broad-banding does NOT apply in these cases (actual % disability is used).
  • 🔒Service element is not taken into account for computing lump-sum compensation.

📌 Illustration (Rule 10(5))

Govt. servant, age 40, Basic Pay = ₹30,000/month, retained in service, disability 40% in Category B:

₹30,000 × 30/100 (disability element) × 40/100 (% disability) × 9.075 (commutation factor, age 41) × 12 = ₹3,92,040

'Date of injury' = actual date of injury in accident or violence (or such date as competent authority may fix, not later than Medical Board report date). 'Date of disease' = date fixed by competent authority having regard to Medical Board opinion (not later than Medical Board report date).

RULE 10(7)

Constant Attendant Allowance (CAA)

  • 🏥Granted to a pensioner eligible for disability pension for 100% disability under these rules.
  • 🩹Condition: Medical Board is of opinion that the pensioner is completely dependent on others for day-to-day activities and needs services of a constant attendant.
  • 💳Rate: As decided by the Government from time to time.
  • 📅Payable for life, in addition to monthly disability pension.
  • 🚫No Dearness Relief is admissible on the Constant Attendant Allowance.
RULE 11

  • ▪️If disability pensioner dies, family gets family pension per Rule 50 of CCS Pension Rules 2021.
  • ▪️Special proviso: If the pensioner dies within 7 years of being boarded out due to the same injury/disease, the family gets family pension at the extraordinary rate (same category, same rate as would be applicable for in-service death).
  • ▪️Whether death is due to same injury/disease → decided by a Medical Board constituted by competent authority under Rule 5.

General Rule: Family pension shall NOT be payable to more than one member of the family at the same time — except in specific cases provided in Rule 12.

RULE 12(3)

Widow / Widower — Detailed Rules

  • 📌Pension payable to widow/widower till death or remarriage — whichever is earlier. Eligibility is NOT affected by income from other sources.
  • 👶Widow re-marries deceased's brother and continues to live communally or contribute to support of other dependants → family pension continues.
  • 💔Childless widow re-marries (other than above) → pension continues if her income from all other sources is less than the minimum family pension + DA. If income later equals or exceeds this, pension stops and passes to next eligible member.
  • ⚔️Widow eligible under Cat. C or D re-marries → from date following remarriage, she gets ordinary family pension (as per Rule 50, CCS Pension Rules 2021); AND pension is also payable to the next eligible family member. On death of widow after remarriage, her pension does NOT pass to anyone else.
  • 👥More than one widow: Family pension paid in equal shares. On death/ineligibility of one widow, her share (100% in Cat. B or 60% in Cat. C/D) passes to her eligible child/children.
RULE 12(4)

  • 🔄Family pension first payable to children below 25 in order of birth; after the eldest becomes ineligible, the next receives it.
  • 👶👶Twin children: Paid in equal shares; when one ceases to be eligible, entire amount reverts to the other.
  • 🏥Disabled child: If the Govt. servant is also survived by children below 25, pension first goes to younger children in birth order; disabled child's pension commences when last child below 25 becomes ineligible.
  • 📋Disability must be such as to prevent the child from earning livelihood — evidenced by certificate from competent authority under RPDA 2016 Rules, OR a 3-member Medical Board (with at least one specialist in the disability).
  • 🔁Certificate of disability: required once if disability is permanent; every 5 years if disability is temporary.
  • 💍Marriage of a disabled child shall NOT render him/her ineligible for family pension.
  • 🚫Son/daughter becomes ineligible from date of marriage/remarriage or from date of starting to earn livelihood.
  • 📅Posthumous son/daughter included in definition of 'son'/'daughter'.
📌 Annual Certificate Requirement

Son/daughter or guardian must furnish a certificate to the Pension Disbursing Authority once a year confirming: (i) has not started earning livelihood; and (ii) has not married/remarried. Disabled child also must certify annually that he/she has not started earning livelihood.

RULE 12(5)

RULE 12(6)

Dependent Siblings

  • 👫Family pension equal to 50% of the rate specified in Rule 11 is payable to a dependent sibling till age 25 or marriage, whichever is earlier.
  • A dependent sibling with mental/physical disability → pension equal to 50% of the sibling rate, payable for life, if wholly dependent on the Govt. servant immediately before death. Minimum: not less than ordinary family pension (CCS Pension Rules 2021).
  • 📝A sibling below 25 is deemed to be earning livelihood if income from other sources is ≥ minimum family pension + DA (and is therefore ineligible). Must furnish annual declaration of not earning livelihood.
  • 💰The income criteria for disabled child (Rule 12(4)) also applies to determine eligibility of a disabled sibling.
RULE 12(7)

Both Spouses are Government Servants

  • 👫If both husband and wife are Govt. servants and one dies, family pension of the deceased is payable to the surviving spouse.
  • 👦👧On death of the surviving spouse, children receive both family pensions in respect of deceased parents.
  • 📋Family pension from one Govt. servant's death shall NOT be counted as income when determining eligibility for family pension from the other's death.
📋 Note — Income Proof for Eligibility

Members of the family (other than widow/widower and parents) must submit copy of last Income Tax Return or, if not filed, a certificate from Sub-Divisional Magistrate. Head of Office may rely on any other document if neither is available.


PART VI

Procedure, Timelines & Power to Relax

RULE 14

Procedure — Sanction of Disability Pension

Head of Office Submits to Competent Authority

On receipt of: statement of circumstances of disablement, findings of Inquiring authority (if any), and Medical Board report.

Competent Authority Decides

If found unfit for service and entitled to disability pension → disability pension and retirement gratuity sanctioned per these rules. If retained in service despite disability → lump-sum compensation in lieu of disability element. (For those covered under Sec. 20 RPDA 2016 → additional steps as per Rule 2).

Govt. Servant Informed — Form E-1 Submitted

Govt. servant submits Form E-1 along with other forms required under CCS Pension Rules 2021.

Head of Office Forwards to Accounts Officer — within 2 months

Completes Part I of Form E-2 (with checklist and pension calculation sheet), Form E-3 (covering letter + Govt. dues), Service Book, and all supporting documents.

Accounts Officer Issues Pension Payment Order — within 1 month

Applies checks, records account enfacement in Part II of Form E-2, assesses disability pension, family pension and retirement gratuity, and issues PPO within one month of receipt from HoO.

Provisional Pension if Decision Pending

If final decision on disability pension is pending, provisional pension and provisional gratuity may be sanctioned per Rule 62 of CCS Pension Rules 2021. Continues till final disability pension is authorised. Final amounts adjusted from provisional amounts. (Form E-4 used for revised authority.)

📋 Bhavishya — Online Processing (Rule 13)

Unless exempted, cases for disability/family pension under these rules shall be processed through 'Bhavishya' (the online pension sanctioning system). Exempted offices process manually. Where any action cannot be performed in Bhavishya, it shall be done manually.

RULE 15

Procedure — Sanction of Family Pension

  • 1️⃣HoO submits statement of circumstances, Inquiring authority findings, and Medical Board report to competent authority (Rule 5).
  • 2️⃣Once decision is taken, eligible family members are informed and asked to submit Form E-5 + other required forms.
  • 3️⃣HoO draws Accounts Officer's attention to outstanding Govt. dues.
  • 4️⃣HoO completes Part I of Form E-6 with checklist, Service Book, and supporting documents, and forwards to Accounts Officer within 2 months of receipt of forms from family.
  • 5️⃣Government dues info furnished in Form E-3 for recovery from death gratuity.
  • 6️⃣Accounts Officer issues pension payment order within 2 months of receipt of family pension case.
  • 7️⃣If final decision pending → provisional family pension and provisional gratuity per Rule 75, CCS Pension Rules 2021. Revised authority issued in Form E-7 when final decision is taken. Final amounts adjusted.
  • 📌If eligibility of a family member is not covered under these rules but is covered under CCS Pension Rules 2021 → the latter applies (if not repugnant to these rules).
RULE 16

Timely Processing & Interest on Delayed Payment

  • Head of Department to ensure all cases processed within timelines specified in Rules 14 & 15, and provisional pension/family pension is sanctioned pending final authorisation.
  • 💸Where provisional pension not sanctioned or payment authorised later than due date AND delay is due to administrative reasons/lapsesinterest shall be paid on arrears and responsibility shall be fixed for the delay (per Rule 65, CCS Pension Rules 2021).
  • 📋A report of all cases where provisional/final pension has been authorised later than due → submitted to the Secretary of Administrative Ministry/Department by 15th January every year.
RULE 17

Power to Relax

  • ⚖️Where a Ministry/Department is satisfied that operation of any rule causes undue hardship in a particular case, it may — by order with recorded reasons — dispense with or relax the requirement of that rule to deal with the case in a just and equitable manner.
  • 🔒No such relaxation order shall be made except with the concurrence of DoPPW (Dept. of Pension and Pensioners' Welfare).

  • ▪️Accidents while travelling on duty in official/public/private/mass transport (train, aircraft, ship, etc.)
  • ▪️Accidents while working on machinery, equipment, boilers, storage tanks, chemicals, etc.
  • ▪️Fire accidents while on duty (other than fire-fighting staff — that is Category C)
  • ▪️Accident during mountaineering/gliding expeditions organised or permitted by service authorities
  • ▪️Electrocution while on duty (other than flood/cyclone relief personnel)
  • ▪️Accident while proceeding from duty station to leave station or returning
  • ▪️Accidents while participating in local/national/international sports tournaments as member of service teams
  • ▪️Accident journeying by reasonable route from official residence to and back from appointed place of duty (any mode of conveyance)

Category C:

  • ▪️Bomb blasts or indiscriminate shooting in public places or public transport
  • ▪️Act of violence or attack by a fellow Govt. servant
  • ▪️Riots/revolt by demonstrators/public servants, causing injuries to Govt. servants employed in aid of civil administration for quelling agitation
  • ▪️Fire-fighting operations by fire-fighting staff
  • ▪️Accidents during test flights of aircraft

Category D:

  • ▪️Attack targeted against the Govt. servant by terrorists/extremists/anti-social elements
  • ▪️Action against terrorists/extremists/anti-social elements
  • ▪️Enemy action in international war, border skirmishes, and warlike situations
  • ▪️Operation to evacuate Indian nationals from war-torn foreign country
  • ▪️Extremist acts / exploding of mines while on way to operational area
  • ▪️After kidnapping by extremists
  • ▪️Training exercises with live ammunition
  • ▪️Acts of violence against Income Tax/Customs/Excise/Central Police Organisations/law enforcement agencies during action against tax evaders/anti-social elements
  • ▪️Acts of violence by terrorists/smugglers/dacoits targeted against individual Govt. servant — (a) to deter/prevent discharge of duties; (b) because of act done in lawful discharge; (c) because of official position
SCHEDULE IV

Guidelines for Conceding Attributability (Rule 5(3))

  • ⚖️Benefit of doubt: All evidence (direct and circumstantial) shall be taken into account and benefit of reasonable doubt given to the claimant, more liberally in field service cases.
  • 📅Post-discharge claims (within 7 years): If a disease did not lead to discharge but arose within 7 years thereafter, may be recognised as attributable to service if medically established as a delayed manifestation of a pathological process set in motion by service conditions.
  • 🏠Disability pensioner dies at home: (a) within 7 years of invaliding → benefit of doubt to family; (b) after 7 years → benefit of doubt to the State. (If death at age 60+ → due to natural causes, not service.)
  • 🩺Death of disability pensioner on aggravation basis: If last assessment ≥ 50% → may be accepted as due to Govt. service. If < 50% → should not be regarded as due to service.

'On Duty' — Definition for Central Armed Police Battalions:

  • Performing an official task or task failure of which would constitute an offence under disciplinary code
  • Moving from one place of duty to another
  • During recreation organised/permitted by service authorities; travelling under organised arrangements
  • Proceeding from duty station to leave station or returning
  • Journeying by reasonable route from official residence to appointed place of duty (any mode)
  • Injury/death even when not strictly 'on duty' — if the risk was enhanced by nature/conditions/obligations of service AND not a risk common to human existence in modern conditions

Disease Guidelines (Schedule IV, Para 7):

  • ▪️If service conditions did not determine onset but influenced subsequent course → aggravation basis
  • ▪️Disease leading to discharge/death → ordinarily deemed to have arisen in service if no note of it at time of acceptance for service
  • ▪️Diseases running independent of external circumstances (e.g. Leukaemia, Hodgkin's) → not accepted as aggravated by service unless exigencies of service delayed/prevented satisfactory treatment
  • ▪️Venereal disease → normally rejected; sequela may be accepted as aggravated if exceptional strain of service hastened its manifestation
  • ▪️Disability/death due to indulgence in drugs or drinks within one's own control → entitlement not conceded
  • ▪️Unforeseen complications from service medical treatment → normally accepted as attributable to service

Assessment Rules:

  • 📐At time of discharge → entire disablement assessed (including pre-existing aggravated conditions); after discharge → non-service factors and natural progress deducted.
  • 👀Paired organs (eyes, ears, arms, legs): Considered together; assessment includes functional defect of the pair. Increases in non-service disablement after discharge normally excluded — except where combined disablement nears 100%.
  • Composite assessments: Two or more service disabilities → composite assessment = arithmetic sum if effects are entirely different; reduced in proportion to overlapping if functional effects overlap.
  • 🔵Nil disablement: Where disability has ceased or become too small to admit assessable compensation, assessment is expressed as "nil disablement".
  • ✂️Where disability due to service has no connection with pre-existing disability → compensation restricted to service disability only.
