Definitions<\/h2>\n    <\/div>\n\n    <p>The rules were made by the President under proviso to Article 309 and Clause (5) of Article 148 of the Constitution, after consultation with the Comptroller &amp; If payment delayed beyond first month after retirement (not due to pensioner's fault), A\/O authorises difference of monthly pension for the intervening period.<\/td>\n        <\/tr>\n        <tr>\n          <td>Applicant requiring <strong>medical examination<\/strong> (Chapter IV)<\/td>\n          <td>Date on which the <strong>medical authority signs the medical report<\/strong> in Part III of Form 4<\/td>\n          <td>(b) Nationalised bank: Date commuted value is <strong>credited to applicant's account<\/strong><\/td>\n        <\/tr>\n        <tr>\n          <td>Commuted value paid in <strong>two or more stages<\/strong> (Rule 9 \/ Rule 10)<\/td>\n          <td>\u2014<\/td>\n          <td>Reduction made from the <strong>respective dates of each payment<\/strong><\/td>\n        <\/tr>\n      <\/tbody>\n    <\/table>\n\n    <div class=\"callout teal\">\n      <div class=\"callout-label\">\ud83d\udccb PPO Entry Requirement<\/div>\n      <p>The date on which commuted value was paid \/ credited to applicant's account shall be entered in <strong>both halves of the Pension Payment Order<\/strong> by the disbursing authority under intimation to the Accounts Officer.<\/p>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"nomination\">\n      <span class=\"section-badge\">RULE 7<\/span>\n      <h3>Nominations<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udcc4<\/span><span>An applicant shall make a nomination in <strong>Form 5<\/strong> along with the application (Form 1 or Form 2), conferring on one or more persons the right to receive the commuted value if the applicant <strong>dies without receiving the commuted value<\/strong> on or after the date commutation became absolute.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udc68\u200d\ud83d\udc69\u200d\ud83d\udc67<\/span><span>If there is <strong>no nomination<\/strong>, or if the nomination does not subsist \u2192 commuted value paid to the <strong>family in the manner under Rule 51(1)(b) of Pension Rules<\/strong>.<\/span><\/li>\n      <li><span class=\"ico\">\u2696\ufe0f<\/span><span>If commuted value cannot be paid per sub-rules (1) and (2) \u2192 paid to the applicant's <strong>heirs<\/strong>.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"section-heading-block\" id=\"calculation\">\n      <span class=\"section-badge\">RULE 8<\/span>\n      <h3>Calculation of Commuted Value<\/h3>\n    <\/div>\n\n    <div class=\"highlight-banner\">\n      <div class=\"hb-icon\">\ud83e\uddee<\/div>\n      <div>\n        <h4>Commuted Value Formula<\/h4>\n        <p>The lump sum payable to an applicant is calculated in accordance with the <span class=\"hb-badge\">Table of Values<\/span> prescribed from time to time and applicable to the applicant on <span class=\"hb-badge\">the date commutation becomes absolute<\/span>. The Table is based on age at next birthday and the amount of pension to be commuted.<\/p>\n      <\/div>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"provisional\">\n      <span class=\"section-badge\">RULE 9<\/span>\n      <h3>Commutation of Provisional Pension<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\u2705<\/span><span>A Govt. servant to whom <strong>provisional pension has been sanctioned<\/strong> under Rule 64 of Pension Rules (pending assessment of final pension) is eligible to commute a fraction of such provisional pension \u2014 subject to the 40% limit (Rule 5).<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>Provisions of Chapter III or Chapter IV (as the case may be) apply to commutation of provisional pension.<\/span><\/li>\n    <\/ul>\n\n    <p><strong>Special provisions for provisional pension applicants requiring medical exam (Chapter IV):<\/strong><\/p>\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>If the fraction of provisional pension to be commuted does NOT exceed <strong>\u20b96,000 p.m.<\/strong> but final pension is expected to exceed \u20b96,000 \u2192 the application is <strong>deemed to be for commutation exceeding \u20b96,000 p.m.<\/strong> (for the purpose of Rule 22 \u2014 Medical Board requirement).<\/span><\/li>\n      <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>If applicant does not indicate expectation of final pension exceeding \u20b96,000 \u2192 treated as applying for commutation up to \u20b96,000 p.m.<\/span><\/li>\n      <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>On final pension determination: if eligible to commute up to \u20b96,000 \u2192 <strong>no fresh medical examination needed<\/strong> for the difference.<\/span><\/li>\n      <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>If on final determination, eligible to commute amount <strong>exceeding \u20b96,000<\/strong> \u2192 must <strong>apply afresh in Form 2<\/strong> for commutation of pension exceeding \u20b9100.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"section-heading-block\" id=\"retrospective\">\n      <span class=\"section-badge\">RULE 10<\/span>\n      <h3>Retrospective Revision of Final Pension<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udcc8<\/span><span>If after commutation, pension is <strong>retrospectively enhanced<\/strong> as a result of Government's decision \u2192 the applicant shall be paid the <strong>difference between commuted value on enhanced pension and commuted value already authorised<\/strong>.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udeab<\/span><span><strong>No fresh application required<\/strong> for payment of the difference.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"callout amber\">\n      <div class=\"callout-label\">\ud83d\udccc Proviso \u2014 Enhancement Beyond \u20b96,000 p.m. After Retrospective Revision<\/div>\n      <ul class=\"icon-list\">\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>If applicant commuted original pension not exceeding \u20b96,000 (declared fit by Civil Surgeon \/ District Medical Officer) and due to retrospective enhancement becomes eligible to commute <strong>more than \u20b96,000 p.m.<\/strong>:<\/span><\/li>\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>Difference between commuted value of \u20b96,000 p.m. and commuted value of the <strong>percentage of original pension<\/strong> \u2192 allowed <strong>without further medical examination<\/strong>.<\/span><\/li>\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>Commutation of any <strong>amount beyond \u20b96,000 p.m.<\/strong> \u2192 treated as <strong>fresh commutation<\/strong>, subject to Medical Board examination.<\/span><\/li>\n      <\/ul>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"restoration\">\n      <span class=\"section-badge teal\">RULE 10A<\/span>\n      <h3>Restoration of Commuted Pension<\/h3>\n    <\/div>\n\n    <div class=\"restoration-card\">\n      <div class=\"restoration-stamp\">\ud83d\udd04 Rule 10A \u2014 Restoration<\/div>\n      <h4>Commuted Pension Restored After 15 Years<\/h4>\n      <p>The commuted amount of pension shall be <strong>restored on completion of fifteen years<\/strong> from the date the reduction of pension on account of commutation becomes operative in accordance with Rule 6.<\/p>\n      <p style=\"margin-top:12px;\"><strong>Where commutation was paid on more than one occasion<\/strong> (due to upward revision of pension) \u2014 the respective commuted amount shall be restored on completion of fifteen years from the <strong>respective date(s)<\/strong> of each such payment.<\/p>\n    <\/div>\n\n    <hr class=\"section-divider\">\n\n    <!-- \u2550\u2550\u2550 PART III \u2550\u2550\u2550 -->\n    <div class=\"chapter-heading-block\" id=\"ch3\">\n      <span class=\"chapter-badge\">PART III<\/span>\n      <h2>Commutation Without Medical Examination (Rules 11\u201316)<\/h2>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"scope-ch3\">\n      <span class=\"section-badge\">RULE 11<\/span>\n      <h3>Scope of Chapter III<\/h3>\n    <\/div>\n\n    <p>The provisions of Chapter III (Rules 11\u201316) shall apply to an applicant who is eligible to commute a percentage of his pension <strong>without medical examination<\/strong>.<\/p>\n\n    <div class=\"section-heading-block\" id=\"no-exam-elig\">\n      <span class=\"section-badge\">RULE 12<\/span>\n      <h3>Eligibility \u2014 Without Medical Examination<\/h3>\n    <\/div>\n\n    <p>An applicant authorised any of the following pensions, who applies in Form 1 or Form 1-A within one year of retirement, is eligible to commute <strong>without medical examination<\/strong>:<\/p>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">1\ufe0f\u20e3<\/span><span><strong>Superannuation pension<\/strong> \u2014 under Rule 35 of Pension Rules<\/span><\/li>\n      <li><span class=\"ico\">2\ufe0f\u20e3<\/span><span><strong>Retiring pension<\/strong> \u2014 under Rule 36 of Pension Rules<\/span><\/li>\n      <li><span class=\"ico\">3\ufe0f\u20e3<\/span><span><strong>Pension on absorption<\/strong> in\/under a corporation\/company\/body under Rule 37 of Pension Rules \u2014 who elects to receive monthly pension and retirement gratuity<\/span><\/li>\n      <li><span class=\"ico\">4\ufe0f\u20e3<\/span><span><strong>Compensation pension<\/strong> on abolition of permanent post \u2014 under Rule 39 of Attests the unattested copy of applicant's photograph. Also sends to HoO a certified copy of Form 4; and to applicant a certified copy of Part III of Form 4.<\/p>\n        <\/div>\n      <\/div>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"second-exam\">\n      <span class=\"section-badge amber\">RULE 26<\/span>\n      <h3>Second Medical Examination (Not an Appeal)<\/h3>\n    <\/div>\n\n    <p>This applies to an applicant who was <strong>refused commutation on medical grounds<\/strong> or who <strong>declined commutation based on age addition<\/strong> (Rule 22(1)(c)) and now desires re-examination:<\/p>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udcc5<\/span><span>Second examination can take place only after expiry of <strong>not less than one year<\/strong> from date of first examination.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udcb8<\/span><span>Re-examination is by a <strong>Medical Board at the applicant's own expense<\/strong>.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udcdd<\/span><span>Applicant addresses a letter to HoO requesting re-examination, indicating: (i) first medical authority and date; (ii) place of examination; (iii) opinion of the medical authority; (iv) date of birth and retirement; (v) designation at retirement; (vi) pension authorised; (vii) % of pension originally applied for commutation.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udd04<\/span><span>HoO addresses CAMA for re-examination and forwards applicant's letter and certified copy of Form 4 from first examination.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udcca<\/span><span>If Medical Board finds in favour of the applicant \u2192 HoO determines commuted value with reference to the Table applicable on the <strong>date Medical Board recorded its opinion<\/strong>, and forwards to A\/O for authorization.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"section-heading-block\" id=\"appeal\">\n      <span class=\"section-badge amber\">RULE 27<\/span>\n      <h3>Appeal Against Findings of Medical Authority<\/h3>\n    <\/div>\n\n    <div class=\"callout amber\">\n      <div class=\"callout-label\">\ud83d\udccb Notwithstanding Rule 26 \u2014 Early Re-examination Possible<\/div>\n      <p>An applicant (Rule 22(1)(c)) who believes the medical authority made an <strong>error of judgement<\/strong> in refusing commutation or adding years to actual age may appeal <strong>before the expiry of one year<\/strong>.<\/p>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\u23f0<\/span><span>Must prefer appeal within <strong>one month<\/strong> of receipt of certified copy of Part III of Form 4 from the medical authority.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udcdd<\/span><span>Address a letter to HoO requesting review by another medical authority <strong>at applicant's own expense<\/strong>, with same particulars as in Rule 26(2).<\/span><\/li>\n    <\/ul>\n\n    <p><strong>How the appeal re-examination is constituted:<\/strong><\/p>\n    <table class=\"compare-table\">\n      <thead><tr><th>First Examiner<\/th><th>Appeal Re-examiner<\/th><\/tr><\/thead>\n      <tbody>\n        <tr><td>Medical Officer (Civil Surgeon \/ District Medical Officer)<\/td><td><span class=\"tag-req\">Medical Board<\/span><\/td><\/tr>\n        <tr><td>Medical Board<\/td><td><span class=\"tag-req\">Second Medical Board<\/span> \u2014 members must be <strong>different<\/strong> from those of the first Board<\/td><\/tr>\n      <\/tbody>\n    <\/table>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>HoO, within <strong>one month<\/strong> of receipt of appeal letter, steps to arrange re-examination and addresses CAMA where applicant was examined previously.<\/span><\/li>\n      <li><span class=\"ico\">\u2696\ufe0f<\/span><span><strong>Findings of the Medical Board in appeal are binding on the applicant.<\/strong><\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udcc5<\/span><span>If the appeal Medical Board sets aside or modifies the first opinion \u2192 finding deemed to have come into force on the date the <strong>first medical authority recorded its opinion<\/strong>; (b) endorse a copy of this communication to HoO.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"section-heading-block\" id=\"ao-payment\">\n      <span class=\"section-badge\">RULE 30<\/span>\n      <h3>Authorization of Payment by the Accounts Officer (Medical Cases)<\/h3>\n    <\/div>\n\n    <p>Subject to Rule 28(2) and (3) provisions, on receipt of documents from the medical authority, A\/O shall <strong>without delay<\/strong> issue an order to the disbursing authority with:<\/p>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>(i) Amount of pension commuted, commuted value of pension, and date on which commutation became absolute<\/span><\/li>\n      <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>(ii) Amount of residuary pension<\/span><\/li>\n      <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>(iii) Form 4 in original<\/span><\/li>\n      <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>(iv) Copy of applicant's photograph as attested by the medical authority<\/span><\/li>\n    <\/ul>\n\n    <p>A\/O shall also:<\/p>\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>Bring to disbursing authority's notice the Rule 6 proviso regarding the date of reduction in original pension.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udce9<\/span><span>Endorse a copy of the order to the applicant with instruction to collect commuted value from the disbursing authority.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udce2<\/span><span>Bring to the applicant's notice the provisions of Rule 6 proviso.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"section-heading-block\" id=\"final-assess\">\n      <span class=\"section-badge\">RULE 31<\/span>\n      <h3>Final Assessment of Provisional Pension (Medical Cases)<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span>An applicant (Rule 9(3)) who received commuted value of provisional pension from HoO, shall on <strong>final assessment of pension<\/strong> be paid by A\/O the <strong>difference between commuted value of final pension and commuted value already paid<\/strong>.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"callout amber\">\n      <div class=\"callout-label\">\ud83d\udccc Proviso \u2014 Final Pension Exceeding \u20b96,000 p.m.<\/div>\n      <ul class=\"icon-list\">\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>If applicant was examined by Medical Officer (for provisional pension up to \u20b96,000) and on final assessment becomes eligible to commute <strong>amount exceeding \u20b96,000 p.m.<\/strong> \u2192<\/span><\/li>\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>Difference between commuted value of \u20b96,000 p.m. and commuted value of provisional pension \u2192 paid <strong>without further medical examination<\/strong>.<\/span><\/li>\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>Commutation of pension <strong>exceeding \u20b96,000 p.m.<\/strong> \u2192 only if applicant applies afresh and is declared fit by a <strong>Medical Board<\/strong>.<\/span><\/li>\n      <\/ul>\n    <\/div>\n\n    <p>The commuted value of provisional pension (as in Form 3 endorsement) shall be deemed amended with the A\/O's authority for the difference between final and provisional commuted values.<\/p>\n\n    <div class=\"section-heading-block\" id=\"interpret\">\n      <span class=\"section-badge\">RULE 32<\/span>\n      <h3>Interpretation<\/h3>\n    <\/div>\n\n    <p>Where any doubt arises as to the interpretation of these rules, it shall be referred to the <strong>Government in the Department of Pension and Pensioners' Welfare<\/strong> for decision.<\/p>\n\n    <div class=\"section-heading-block\" id=\"relax\">\n      <span class=\"section-badge\">RULE 33<\/span>\n      <h3>Power to Relax<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\u2696\ufe0f<\/span><span>A Ministry\/Department may, where satisfied that operation of any rule causes <strong>undue hardship<\/strong> in a particular case, by order with <strong>recorded reasons<\/strong>, dispense with or relax the requirements of that rule to deal with the case in a <strong>just and equitable manner<\/strong>.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udd12<\/span><span>No such order shall be made except with the <strong>concurrence of DoPPW<\/strong> (Department of Pension and Pensioners' Welfare).<\/span><\/li>\n    <\/ul>\n\n    <div class=\"section-heading-block\" id=\"repeal\">\n      <span class=\"section-badge\">RULE 34<\/span>\n      <h3>Repeal &amp; Savings<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udcdc<\/span><span>All earlier rules, regulations, orders, and OMs in force immediately before the commencement of these rules (in so far as they provide for any matters contained in these rules) shall <strong>cease to operate<\/strong> on commencement of these rules.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span><strong>Savings:<\/strong> (a) Any pending application for commutation at commencement shall be disposed of in accordance with the <strong>old rules<\/strong>.
