Key Definitions<\/h2>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"application\">\n      <span class=\"section-badge\">RULE 2<\/span>\n      <h3>Application of Rules<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\u2705<\/span><span>These rules apply to Government servants to whom the <strong>Central Civil Services (Pension) Rules, 2021<\/strong> apply.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span><strong>NPS employees (CCS NPS Rules 2021):<\/strong> Benefits of <strong>family pension, disability pension and constant attendant allowance<\/strong> are payable IF the Government servant had exercised an <strong>option to this effect under Rule 10<\/strong> of CCS (NPS) Rules, 2021 \u2014 triggered only on death or discharge due to disability.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udeab<\/span><span><strong>Excluded:<\/strong> No benefits under these rules for a Govt. servant who dies or gets disabled <strong>while on foreign service under a UN body<\/strong>, if the employee had opted NOT to pay pension contributions during the deputation and not to count that service as qualifying service (per Rule 29, CCS Pension Rules, 2021).<\/span><\/li>\n    <\/ul>\n\n    <div class=\"callout teal\">\n      <div class=\"callout-label\">\u267f Divyaang \/ Disability \u2014 Section 20, Rights of Persons with Disabilities Act, 2016<\/div>\n      <ul class=\"icon-list\">\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>Where Section 20 of RPDA 2016 applies, the case is governed by that section first.<\/span><\/li>\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>If a Govt. servant covered under Sec. 20 wants to retire and claim benefits, they <strong>must be advised of their option to continue in service<\/strong> with same pay and benefits.<\/span><\/li>\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>If they still proceed with retirement, their disability pension case is processed under these rules.<\/span><\/li>\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>Establishments <strong>exempted from Sec. 20<\/strong> (by notification under Sec. 20(1) proviso) \u2014 employees boarded out are eligible for disability pension under these rules. If fit for less laborious duty, they may be employed on a lower post (subject to willingness); if not willing or no lower post, disability pension is granted.<\/span><\/li>\n        <li><span class=\"ico\">\u25aa\ufe0f<\/span><span>If such an employee is <strong>retained in service<\/strong> despite disablement, lump-sum compensation in lieu of disability element is paid [per Rule 10(5)].<\/span><\/li>\n      <\/ul>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"definitions\">\n      <span class=\"section-badge\">RULE 3<\/span>\n      <h3>Key Definitions<\/h3>\n    <\/div>\n\n    <table class=\"compare-table\">\n      <thead><tr><th>Term<\/th><th>Definition<\/th><\/tr><\/thead>\n      <tbody>\n        <tr><td><strong>Accident<\/strong><\/td><td>A <em>sudden and unavoidable mishap<\/em>; OR a mishap due to an act of devotion to duty performed in an emergent situation arising in course of service or otherwise. <strong>Does NOT include<\/strong> an incident of violence.<\/td><\/tr>\n        <tr><td><strong>Violence<\/strong><\/td><td>An act by a person\/persons to inflict injury on a Govt. servant by assaulting\/obstructing\/deterring\/preventing him in discharge of duties \u2014 (i) by virtue of anything done\/attempted by such Govt. servant or any other public servant in lawful discharge of duty; or (ii) by virtue of his official position. Also includes injury as a collateral victim due to presence at place of incident in connection with official duty.<\/td><\/tr>\n        <tr><td><strong>Disability<\/strong><\/td><td>A condition resulting in long-term physical, mental, intellectual or sensory impairment which, in interaction with barriers, hinders full and effective participation in society equally with others.<\/td><\/tr>\n        <tr><td><strong>Disease<\/strong><\/td><td>Includes a disease as mentioned in Schedule-I.<\/td><\/tr>\n        <tr><td><strong>Injury<\/strong><\/td><td>Includes an injury as mentioned in Schedule-II.<\/td><\/tr>\n        <tr><td><strong>Pay<\/strong><\/td><td>Basic pay (as per FR 9(21)(a)(i)) the Govt. servant was receiving immediately before retirement or death; or on date of injury\/disease in case of retention in service. <strong>Also includes<\/strong>: stagnation increment and non-practising allowance granted to a medical officer in lieu of private practice.<\/td><\/tr>\n      <\/tbody>\n    <\/table>\n\n    <hr class=\"section-divider\">\n\n    <!-- PART II -->\n    <div class=\"chapter-heading-block\" id=\"ch2\">\n      <span class=\"chapter-badge\">PART II<\/span>\n      <h2>Grant Conditions, Authority &amp; Categories<\/h2>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"conditions\">\n      <span class=\"section-badge\">RULE 4<\/span>\n      <h3>Conditions for Grant of Disability Pension or Family Pension<\/h3>\n    <\/div>\n\n    <p>A disability pension or family pension shall be granted <strong>only if there is a causal connection<\/strong> between:<\/p>\n\n    <div class=\"cat-grid\">\n      <div class=\"cat-card b\">\n        <span class=\"cat-badge\">A<\/span>\n        <div class=\"cat-label\">For Disability Pension<\/div>\n        <div class=\"cat-title\">Disablement \u2194 Govt. Service<\/div>\n        <p>The disablement must be certified as due to wound, injury or disease: (a) attributable to Govt. service; OR (b) existing before or arising during service and aggravated thereby.<\/p>\n      <\/div>\n      <div class=\"cat-card c\">\n        <span class=\"cat-badge\">B<\/span>\n        <div class=\"cat-label\">For Family Pension<\/div>\n        <div class=\"cat-title\">Death \u2194 Govt. Service<\/div>\n        <p>Death must be certified as caused due to or hastened by: (a) wound, injury or disease attributable to service; OR (b) aggravation of a pre-existing condition attributable to service.<\/p>\n      <\/div>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udcdd<\/span><span><strong>No application required:<\/strong> It shall NOT be necessary for the Govt. servant or the family to submit any application for grant of these pensions under these rules.<\/span><\/li>\n      <li><span class=\"ico\">\ud83c\udfe2<\/span><span><strong>Head of Office responsibility:<\/strong> Must consider each case of death or disability and submit to competent authority within <strong>3 months<\/strong> of receipt of Medical Board report. Claim shall NOT be rejected due to delay on the part of HoO.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udca1<\/span><span>Disability pension consists of a <strong>service element + disability element<\/strong> (determined per Rule 10).<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udccc<\/span><span>On death of a disability pensioner, <strong>family pension is payable<\/strong> per Rule 11(2).<\/span><\/li>\n    <\/ul>\n\n    <div class=\"section-heading-block\" id=\"authority\">\n      <span class=\"section-badge\">RULE 5<\/span>\n      <h3>Authority for Grant of Disability \/ Family Pension<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83c\udfdb\ufe0f<\/span><span>Power is exercised by the <strong>Secretary of that Ministry\/Department<\/strong> OR any officer not below the rank of <strong>Joint Secretary<\/strong> (to GoI) to whom this power is delegated, in consultation with the Financial Adviser.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udd3d<\/span><span>The Secretary may further delegate to an officer not below the rank of Joint Secretary of the concerned organisation\/office (with Financial Adviser concurrence).<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>Each case must be examined per <strong>guidelines in Schedule IV<\/strong>.<\/span><\/li>\n      <li><span class=\"ico\">\u2705<\/span><span>The authority must <strong>satisfy itself<\/strong> that conditions in Rule 4 are met and certify causal connection between disablement\/death and Govt. service.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"callout amber\">\n      <div class=\"callout-label\">\u26a0\ufe0f Note 1 \u2014 Schedule IV Guidelines<\/div>\n      <p>Schedule IV guidelines aim to determine attributability of disablement or death to service. If a case is NOT strictly covered by Schedule IV guidelines but the authority is of the opinion that disablement\/death is otherwise attributable to service, it may <strong>record reasons in writing<\/strong> and still grant the pension.<\/p>\n    <\/div>\n    <div class=\"callout amber\">\n      <div class=\"callout-label\">\u26a0\ufe0f Note 2 \u2014 No Medical Report Secured<\/div>\n      <p>If a Govt. servant died in circumstances where a medical report could not be secured, the competent authority may award family pension under these rules if <strong>otherwise satisfied<\/strong> of the causal connection.<\/p>\n    <\/div>\n\n    <div class=\"section-heading-block\" id=\"other-conditions\">\n      <span class=\"section-badge\">RULE 6<\/span>\n      <h3>Other Conditions<\/h3>\n    <\/div>\n\n    <ul class=\"icon-list\">\n      <li><span class=\"ico\">\ud83d\udeab<\/span><span>Where pension\/family pension\/gratuity under these rules is granted for a period of service, <strong>no pension\/family pension\/gratuity under any other rules<\/strong> shall be payable for the said period during the currency of the grant.<\/span><\/li>\n      <li><span class=\"ico\">\ud83d\udd12<\/span><span>The <strong>disability element<\/strong> of disability pension shall <strong>NOT<\/strong> be taken into account in fixing pay on re-employment in Govt. service.<\/span><\/li>\n    <\/ul>\n\n    <div class=\"section-heading-block\" id=\"categories\">\n      <span class=\"section-badge\">RULE 9<\/span>\n      <h3>Classification \u2014 4 Categories of Death \/ Disability<\/h3>\n    <\/div>\n\n    <div class=\"cat-grid\" style=\"grid-template-columns: repeat(2,1fr);\">\n      <div class=\"cat-card a\">\n        <span class=\"cat-badge\">A<\/span>\n        <div class=\"cat-label\">Category A<\/div>\n        <div class=\"cat-title\">Natural Causes \u2014 Not attributable to Govt. Service<\/div>\n        <p>Death or disability due to natural causes where there is NO causal connection with Govt. service. Pension\/family pension governed by <strong>CCS (Pension) Rules, 2021<\/strong> \u2014 not these extraordinary rules.<\/p>\n      <\/div>\n      <div class=\"cat-card b\">\n        <span class=\"cat-badge\">B<\/span>\n        <div class=\"cat-label\">Category B<\/div>\n        <div class=\"cat-title\">Attributable to \/ Aggravated by Govt. Service<\/div>\n        <p>Diseases from continued exposure to hostile environment or occupational hazards\/extreme weather; accidents while on duty (not covered in C or D). <strong>Disability element = 30% of emoluments for 100% disability.<\/strong><\/p>\n      <\/div>\n      <div class=\"cat-card c\">\n        <span class=\"cat-badge\">C<\/span>\n        <div class=\"cat-label\">Category C<\/div>\n        <div class=\"cat-title\">Acts of Violence \/ Riots \/ Specific Hazardous Ops<\/div>\n        <p>Violence by terrorists in public places (non-targeted); attack by fellow Govt. servant; riots; fire-fighting operations; test flights of aircraft. <strong>Family pension = 100% of pay; Disability element = 30%.<\/strong><\/p>\n      <\/div>\n      <div class=\"cat-card d\">\n        <span class=\"cat-badge\">D<\/span>\n        <div class=\"cat-label\">Category D<\/div>\n        <div class=\"cat-title\">Targeted Attack \/ Enemy Action \/ Warlike Operations<\/div>\n        <p>Attack targeted against the Govt. servant by terrorists; action against extremists; enemy action\/war\/border skirmishes; evacuation from war-torn country; kidnapping by extremists; live-ammunition training. <strong>Disability element = 100% of emoluments; Family pension = 100% of pay.<\/strong><\/p>\n      <\/div>\n    <\/div>\n\n    <div class=\"callout\">\n      <div class=\"callout-label\">\u2139\ufe0f Key Point<\/div>\n      <p>Category A \u2192 CCS (Pension) Rules, 2021. Head of Office may allow <strong>spouse or eligible family member<\/strong> to appeal if the Govt. servant is incapacitated.<\/p>\n        <\/div>\n      <\/div>\n      <div class=\"flow-step\">\n        <div class=\"flow-num\">3<\/div>\n        <div class=\"flow-content\">\n          <h5>Medical Certificate as Evidence<\/h5>\n          <p>A medical certificate produced by Govt. servant\/family shall NOT be considered unless it contains a note by the practitioner that <strong>it was given in full knowledge<\/strong> of the previous Medical Board's findings.<\/p>\n        <\/div>\n      <\/div>\n      <div class=\"flow-step\">\n        <div class=\"flow-num\">4<\/div>\n        <div class=\"flow-content\">\n          <h5>Review Medical Board<\/h5>\n          <p>If appeal is supported by such a certificate \u2192 <strong>Review Medical Board constituted<\/strong> by the competent authority (Rule 5).
