Pension System) Rules, 2021<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Commencement<\/h4>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>They shall come into force on the <strong>date of their publication in the Official Gazette<\/strong><\/span><\/li>\r\n    <li><span class=\"rule-heading-block\" id=\"r2\">\r\n    <span class=\"rule-badge\">RULE 2<\/span>\r\n    <h3>Application<\/h3>\r\n  <\/div>\r\n\r\n  <p>Save as otherwise provided in these rules, these rules shall apply to:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc65<\/span><span>The <strong>Government servants<\/strong> including civilian Government servants in the Defence Services<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Appointed <strong>substantively<\/strong> to civil services and posts in connection with the affairs of the Union<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>On or after the <strong>1st day of January 2004<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>To whom the <strong>Central Civil Services (Implementation of National Pension System) Rules, 2021<\/strong> apply<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Exception for Certain Cases<\/div>\r\n    <p>In the case of a Government servant who:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udc80<\/span><span><strong>Dies during service<\/strong>, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83c\udfe5<\/span><span>Is <strong>boarded out on account of disablement<\/strong>, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\u2695\ufe0f<\/span><span><strong>Retires on invalidation<\/strong><\/span><\/li>\r\n    <\/ul>\r\n    <p style=\"margin-top:10px;\"><strong>AND who had exercised option under rule 10<\/strong> of the CCS (Implementation of NPS) Rules, 2021 for availing benefits under:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:6px;\">\r\n      <li><span class=\"ico\">\ud83d\udcdc<\/span><span>Central Civil Services (Pension) Rules, 1972, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcdc<\/span><span>Central Civil Services (Extraordinary Pension) Rules, 1939<\/span><\/li>\r\n    <\/ul>\r\n    <p style=\"margin-top:10px;\"><strong>Payment of gratuity shall be made in accordance with the said rules.<\/strong><\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-keypoints\">\r\n    <div class=\"box-label\">\ud83d\udd11 Key Point \u2014 Who is Covered?<\/div>\r\n    <p>These rules apply to <strong>NPS subscribers<\/strong> (joined on or after 01.01.2004), but if they opted for old pension rules in cases of death\/disability\/invalidation, then old pension rules apply for gratuity too.<\/p>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 3 -->\r\n  <div class=\"rule-heading-block\" id=\"r3\">\r\n    <span class=\"rule-badge\">RULE 3<\/span>\r\n    <h3>Definitions<\/h3>\r\n  <\/div>\r\n\r\n  <p>In these rules, unless the context otherwise requires:<\/p>\r\n\r\n  <h4>Sub-rule (1) \u2014 Specific Definitions<\/h4>\r\n\r\n  <h4>(a) 'Accounts Officer'<\/h4>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc64<\/span><span>An officer, whatever his official designation, of a Ministry or Department functioning under the scheme of departmentalisation of accounts<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcbc<\/span><span>Who, inter-alia is responsible for receipts, payments, Internal Audit and accounting functions of an office or Department or Ministry<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Includes officers subordinate to the Accountant General who is entrusted with maintaining the accounts of the Central Government or Union territory<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>(b) 'Allottee'<\/h4>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfe0<\/span><span>A Government servant to Rules<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Any claim to gratuity shall be regulated by the <strong>provisions of these rules in force at the time when<\/strong> a Government servant:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udf93<\/span><span>Retires or is retired, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Is discharged, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u270d\ufe0f<\/span><span>Is allowed to resign from service, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc80<\/span><span>Dies<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Last Working Day<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>The day on which a Government servant retires or is retired or is discharged or is allowed to resign from service shall be treated as his <strong>last working day<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc80<\/span><span>The <strong>date of death<\/strong> of a Government servant shall also be treated as a <strong>working day<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-keypoints\">\r\n    <div class=\"box-label\">\ud83d\udca1 Practical Implication<\/div>\r\n    <p>The date of retirement\/death counts as a full working day for calculation of service and gratuity. This ensures no loss of benefits for the last day of service.<\/p>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 5 -->\r\n  <div class=\"rule-heading-block\" id=\"r5\">\r\n    <span class=\"rule-badge\">RULE 5<\/span>\r\n    <h3>Right of President to Withhold Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Presidential Powers<\/h4>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\u2696\ufe0f Presidential Discretion<\/div>\r\n    <p>The President reserves to himself the right of:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udeab<\/span><span><strong>Withholding gratuity<\/strong>, either in full or in part<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span><strong>Ordering recovery from gratuity<\/strong> of the whole or part of any pecuniary loss caused to the Government<\/span><\/li>\r\n    <\/ul>\r\n    <p style=\"margin-top:10px;\"><strong>If:<\/strong> In any departmental or judicial proceedings instituted while the Government servant was in service, the retired Government servant is found guilty of <strong>grave misconduct or negligence<\/strong><\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 UPSC Consultation<\/div>\r\n    <p>The <strong>Union Public Service Commission shall be consulted<\/strong> before any final orders are passed by the President under this rule.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Departmental Proceedings After Retirement<\/h4>\r\n\r\n  <p><strong>(a) Continuation of Proceedings:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The departmental proceedings referred to in sub-rule (1), shall, after the retirement of the Government servant, be <strong>deemed to be proceedings under this rule<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Shall be <strong>continued and concluded<\/strong> by the authority by which they were commenced<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span>In the same manner as if the Government servant had continued in service<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udce4 Proviso \u2014 Submission of Report<\/div>\r\n    <p>In all cases where the departmental proceedings are instituted by an authority subordinate to the President, that authority shall <strong>submit a report recording its findings to the President<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <p><strong>(b) Suspension of Gratuity Payment:<\/strong><\/p>\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\u23f8\ufe0f No Payment Until Conclusion<\/div>\r\n    <p><strong>No gratuity shall be payable<\/strong> to the Government servant until:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\u2705<\/span><span>The conclusion of the departmental or judicial proceedings, AND<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>Issue of final orders thereon<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (3) \u2014 Revisional Powers<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>The President may at any time, either on his own motion or otherwise, <strong>call for the records of any inquiry<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Revise any order made under these rules and may:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>Confirm the order<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>Modify the order<\/span><\/li>\r\n    <li><span class=\"ico\">\u274c<\/span><span>Set aside the order<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Remit the case to an authority directing such authority to make further enquiry<\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Pass such other order as he may deem fit<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udee1\ufe0f Proviso \u2014 Protection Against Enhancement<\/div>\r\n    <p>No order <strong>enhancing the amount of gratuity to be withheld or withdrawn<\/strong>, shall be made.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (4) \u2014 Review Powers<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udd0d<\/span><span>The President may at any time, either on his own motion or otherwise, <strong>review any order<\/strong> passed under these rules where:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span><strong>Extenuating or special circumstances<\/strong> exist to warrant such review, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc4<\/span><span><strong>New material or evidence<\/strong> which could not be produced or was not available at the time of passing of the order and which has the effect of changing the nature of the case, has come or has been brought to his notice<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udee1\ufe0f Proviso \u2014 Protection Against Enhancement<\/div>\r\n    <p>No order <strong>enhancing the amount of gratuity to be withheld or withdrawn<\/strong>, shall be made.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (5) \u2014 When Proceedings Deemed to be Instituted<\/h4>\r\n\r\n  <p><strong>(a) Departmental Proceedings:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>Deemed to be instituted on the date on which the <strong>statement of charges is issued<\/strong> to the Government servant or pensioner<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>OR if the Government servant has been <strong>placed under suspension from an earlier date<\/strong>, on such date<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(b) Judicial Proceedings:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span><strong>(i) Criminal proceedings:<\/strong> On the date on which the complaint or report of a police officer, of which the Magistrate takes cognizance, is made<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span><strong>(ii) Civil proceedings:<\/strong> On the date the plaint is presented in the court<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- class=\"chapter-heading-block\" id=\"ch3\">\r\n    <span class=\"chapter-badge\">CHAPTER III<\/span>\r\n    <h2>Emoluments and Average Emoluments<\/h2>\r\n  <\/div>\r\n\r\n  <!-- RULE 6 -->\r\n  <div class=\"rule-heading-block\" id=\"r6\">\r\n    <span class=\"rule-badge\">RULE 6<\/span>\r\n    <h3>Emoluments<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 What Constitutes Emoluments<\/h4>\r\n\r\n  <p>The expression 'emoluments' for the purpose of determining the amount of gratuity payable under these rules shall include:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The <strong>basic pay<\/strong> as defined in rule 9(21)(a)(i) of the Fundamental Rules, 1922<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>Which a Government servant was receiving <strong>immediately before his retirement or on the date of his death<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc8a<\/span><span>Shall also include <strong>non-practicing allowance<\/strong> granted to medical officer in lieu of private practice<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcda<\/span>\r\n    <span><strong>EXPLANATION:<\/strong> For the purposes of this sub-rule, <strong>stagnation increment<\/strong> shall be treated as emoluments for calculation of gratuity.<\/span>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Absence from Duty or Suspension<\/h4>\r\n\r\n  <p>Where a Government servant immediately before his retirement or death while in service had been:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span><strong>Absent from duty<\/strong>, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Was on <strong>leave for which leave salary is payable<\/strong>, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f8\ufe0f<\/span><span>Having been <strong>suspended<\/strong> had been reinstated without forfeiture of service<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>The emoluments which he would have drawn had he not been absent from duty or suspended<\/strong> shall be the emoluments for the purposes of this rule.<\/p>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Undrawn Increments<\/div>\r\n    <p>Any increase in pay [other than the increment referred to in sub-rule (5)] which is <strong>not actually drawn<\/strong> shall not form the part of his emoluments.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (3) \u2014 Leave After Holding Higher Appointment<\/h4>\r\n\r\n  <p>Where a Government servant immediately before his retirement or death while in service had:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Proceeded on leave for which leave salary is payable<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc54<\/span><span>After having held a <strong>higher appointment<\/strong> whether in an officiating or temporary capacity<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>The benefit of emoluments drawn in such higher appointment shall be given only if:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>It is certified that the Government servant <strong>would have continued to hold the higher appointment<\/strong> but for his proceeding on leave<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (4) \u2014 Extraordinary Leave or Non-Counting Suspension<\/h4>\r\n\r\n  <p>Where a Government servant immediately before his retirement or death while in service had been:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>Absent from duty on <strong>extraordinary leave<\/strong>, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f8\ufe0f<\/span><span>Had been under <strong>suspension<\/strong>, the period whereof <strong>does not count as service<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>The emoluments which he drew immediately before<\/strong> proceeding on such leave or being placed under suspension shall be the emoluments for the purposes of this rule.<\/p>\r\n\r\n  <h4>Sub-rule (5) \u2014 Increment During Earned Leave<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udca1 Special Provision \u2014 Earned Leave Increments<\/div>\r\n    <p>Where a Government servant immediately before his retirement or death while in service, was on <strong>earned leave<\/strong>, and earned an <strong>increment which was not withheld<\/strong>:<\/p>\r\n    <p style=\"margin-top:10px;\"><strong>Such increment though not actually drawn, shall form part of his emoluments<\/strong><\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u23f0 Proviso \u2014 Time Limit for Earned Leave Increment<\/div>\r\n    <p>The increment was earned:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\u2705<\/span><span>During the currency of the earned leave <strong>not exceeding one hundred and twenty days<\/strong>, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcc5<\/span><span>During the <strong>first one hundred and twenty days<\/strong> of earned leave where such leave was for more than one hundred and twenty days<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (6) \u2014 Deputation to Central Government\/Armed Forces<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>Pay drawn by a Government servant while on deputation to:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfdb\ufe0f<\/span><span>Another Central Government Department, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udf96\ufe0f<\/span><span>The Armed Forces of India<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>Shall be treated as emoluments.<\/strong><\/p>\r\n\r\n  <h4>Sub-rule (7) \u2014 Foreign Service<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udf0d<\/span><span>Pay drawn by a Government servant while on <strong>foreign service shall NOT be treated as emoluments<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The pay which he <strong>would have drawn under the Government<\/strong> had he not been on foreign service shall alone be treated as emoluments<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (8) \u2014 Re-employment of Pensioner<\/h4>\r\n\r\n  <p>Where a pensioner who is re-employed in Government service and whose pay on re-employment has been reduced by an amount not exceeding his monthly pension:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb5<\/span><span>The <strong>element of monthly pension by which his pay is reduced<\/strong> shall be treated as emoluments<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 7 -->\r\n  <div class=\"rule-heading-block\" id=\"r7\">\r\n    <span class=\"rule-badge\">RULE 7<\/span>\r\n    <h3>Average Emoluments<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Calculation Period<\/h4>\r\n\r\n  <div class=\"box-definition\">\r\n    <div class=\"box-label\">\ud83d\udcca Calculation Formula<\/div>\r\n    <p>Average emoluments shall be determined with reference to the <strong>emoluments drawn by a Government servant during the last ten months of his service<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Absence from Duty or Suspension<\/h4>\r\n\r\n  <p>Where during the last ten months of his service, a Government servant had been:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span>Absent from duty on leave for which leave salary is payable, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f8\ufe0f<\/span><span>Having been suspended had been reinstated without forfeiture of service<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>The emoluments which he would have drawn<\/strong> had he not been absent from duty or suspended shall be taken into account for determining the average emoluments.<\/p>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Undrawn Increments<\/div>\r\n    <p>Any increase in pay [other than the increment referred to in sub-rule (4)] which is <strong>not actually drawn<\/strong> shall not form the part of his emoluments.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (3) \u2014 Extraordinary Leave or Non-Counting Suspension<\/h4>\r\n\r\n  <p>Where during the last ten months of his service, a Government servant had been:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>Absent from duty on <strong>extraordinary leave<\/strong>, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f8\ufe0f<\/span><span>Had been under <strong>suspension<\/strong> the period whereof does not count as service<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>The aforesaid period of leave or suspension shall be:<\/strong><\/p>\r\n  <ul class=\"ico\">\u2795<\/span><span><strong>Equal period before the ten months<\/strong> shall be included<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcc5<\/span>\r\n    <span><strong>CALCULATION NOTE:<\/strong> In order that the fractions of a month, when added, worked out to one full month, a month for this purpose shall be reckoned as consisting of <strong>thirty days<\/strong>.<\/span>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (4) \u2014 Increment During Earned Leave<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udca1 Earned Leave Increment Inclusion<\/div>\r\n    <p>Where a Government servant who was on earned leave during the last ten months of his service and earned an <strong>increment which was not withheld<\/strong>:<\/p>\r\n    <p style=\"margin-top:10px;\"><strong>Such increment though not actually drawn shall be included in the average emoluments<\/strong><\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u23f0 Proviso \u2014 Time Limit<\/div>\r\n    <p>The increment was earned:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\u2705<\/span><span>During the currency of the earned leave <strong>not exceeding one hundred and twenty days<\/strong>, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcc5<\/span><span>During the <strong>first one hundred and twenty days<\/strong> of earned leave where such leave was for more than one hundred and twenty days<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n <hr class=\"section-divider\">\r\n\r\n  <!-- class=\"rule-heading-block\" id=\"r8\">\r\n    <span class=\"rule-badge\">RULE 8<\/span>\r\n    <h3>Commencement of Qualifying Service<\/h3>\r\n  <\/div>\r\n\r\n  <p>Subject to the provisions of these rules, qualifying service of a Government servant shall commence from:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>The date he <strong>takes charge of the post<\/strong> to which he is first appointed<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc54<\/span><span>Either substantively OR in an officiating or temporary capacity<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Condition for Officiating\/Temporary Service<\/div>\r\n    <p>Officiating or temporary service is followed <strong>without interruption<\/strong> by substantive appointment in the same or another service or post.<\/p>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 9 -->\r\n  <div class=\"rule-heading-block\" id=\"r9\">\r\n    <span class=\"rule-badge\">RULE 9<\/span>\r\n    <h3>Conditions Subject to Which Service Qualifies<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Basic Qualifying Conditions<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>The service of a Government servant shall not qualify, unless:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>His <strong>duties and pay are regulated by the Government<\/strong>, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcdc<\/span><span>Under <strong>conditions determined by the Government<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcda<\/span>\r\n    <span><strong>EXPLANATION:<\/strong> For the purposes of this sub-rule, the expression \"service\" means service under the Government and paid by that Government from the <strong>Consolidated Fund of India<\/strong> or a <strong>Local Fund administered by that Government<\/strong>.<\/span>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Transfer from State Government<\/h4>\r\n\r\n  <p>In the case of Government servant belonging to a State Government who is permanently transferred to a service or post to which these rules apply:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>The <strong>continuous service rendered under the State Government<\/strong> in an officiating or temporary capacity, if any, followed without interruption by substantive appointment, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The continuous service rendered under that Government in an officiating or temporary capacity<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>Shall qualify.<\/strong><\/p>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 10 -->\r\n  <div class=\"rule-heading-block\" id=\"r10\">\r\n    <span class=\"rule-badge\">RULE 10<\/span>\r\n    <h3>Counting of Service on Probation<\/h3>\r\n  <\/div>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>Service on probation against a post if followed by <strong>confirmation in the same or another post<\/strong> shall qualify<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 11 -->\r\n  <div class=\"rule-heading-block\" id=\"r11\">\r\n    <span class=\"rule-badge\">RULE 11<\/span>\r\n    <h3>Counting of Service as Apprentice<\/h3>\r\n  <\/div>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>Service as an apprentice shall <strong>not qualify<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Exception \u2014 SAS Apprentices<\/div>\r\n    <p>Except in the case of:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83d\udcca<\/span><span><strong>Subordinate Audit or Account Services (S.A.S.) apprentice<\/strong> in the Indian Audit and Accounts Department, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83c\udf96\ufe0f<\/span><span>The Defence Accounts Department<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 12 -->\r\n  <div class=\"rule-heading-block\" id=\"r12\">\r\n    <span class=\"rule-badge\">RULE 12<\/span>\r\n    <h3>Counting of Periods Spent on Leave<\/h3>\r\n  <\/div>\r\n\r\n  <p>The following leave shall count as qualifying service:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span><strong>All leave during service<\/strong> for which leave salary is payable<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfe5<\/span><span><strong>All extraordinary leave granted on medical certificate<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Other Extraordinary Leave<\/div>\r\n    <p>In the case of <strong>extraordinary leave other than<\/strong> extraordinary leave granted on medical certificate:<\/p>\r\n    <p style=\"margin-top:10px;\">The appointing authority may, <strong>at the time of granting such leave<\/strong>, allow the period of that leave to count as qualifying service if such leave is granted to a Government servant:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83c\udf2a\ufe0f<\/span><span><strong>(i)<\/strong> Due to his inability to join or rejoin duty on account of <strong>civil commotion<\/strong><\/span><\/li>\r\n      <li><span class=\"ico\">\ud83c\udf93<\/span><span><strong>(ii)<\/strong> For pursuing <strong>higher studies<\/strong> considered useful in discharge of the official duty of the Government servant<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 13 -->\r\n  <div class=\"rule-heading-block\" id=\"r13\">\r\n    <span class=\"rule-badge\">RULE 13<\/span>\r\n    <h3>Counting of Periods Spent on Training<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Training for Group 'A' or Group 'B' Posts<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>The Government may, by order, decide whether the time spent by a Government servant under training <strong>immediately before appointment to a Group 'A' or Group 'B' post<\/strong> under that Government shall count as qualifying service<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Training for Group 'C' Posts<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>Time spent by a Government servant under training <strong>immediately before appointment to a Group 'C' post<\/strong> under the Government <strong>shall count as qualifying service<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Departmental Training for Group 'C' Employees<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udca1 Special Provision for Group 'C' Training<\/div>\r\n    <p>Group 'C' employees, who are required to undergo <strong>departmental training relating to jobs<\/strong> before they are put on regular employment:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\u2705<\/span><span>Training period may be treated as <strong>qualifying service for gratuity<\/strong><\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>If the training is followed <strong>immediately by an appointment<\/strong><\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The benefit shall be admissible to Group 'C' employees even if the officers concerned are <strong>not given the scale of pay<\/strong> of the post but only a nominal allowance<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 14 -->\r\n  <div class=\"rule-heading-block\" id=\"r14\">\r\n    <span class=\"rule-badge\">RULE 14<\/span>\r\n    <h3>Counting of Periods of Suspension<\/h3>\r\n  <\/div>\r\n\r\n  <p>Time passed by a Government servant under suspension pending inquiry into conduct shall count as qualifying service where:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>On conclusion of such inquiry, he has been <strong>fully exonerated<\/strong>, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>A <strong>minor penalty is imposed<\/strong> on the Government servant, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>The suspension is held to be <strong>wholly unjustified<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\u26a0\ufe0f In Other Cases<\/div>\r\n    <p>In other cases, the period of suspension shall <strong>not count<\/strong> unless:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\u2696\ufe0f<\/span><span>The authority competent to pass orders under the rule governing such cases <strong>expressly declares at the time<\/strong> that it shall count to such extent as the Competent Authority may declare<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 15 -->\r\n  <div class=\"rule-heading-block\" id=\"r15\">\r\n    <span class=\"rule-badge\">RULE 15<\/span>\r\n    <h3>Forfeiture of Service on Dismissal or Removal<\/h3>\r\n  <\/div>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\ud83d\udeab Complete Forfeiture<\/div>\r\n    <p>Dismissal or removal of a Government servant from a service or post entails <strong>forfeiture of his past service<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 16 -->\r\n  <div class=\"rule-heading-block\" id=\"r16\">\r\n    <span class=\"rule-badge\">RULE 16<\/span>\r\n    <h3>Counting of Past Service on Reinstatement<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Reinstatement After Appeal or Review<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>A Government servant who is dismissed, removed or compulsorily retired from service, but is <strong>reinstated on appeal or review<\/strong>, is entitled to count his <strong>past service as qualifying service<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Period of Interruption<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u23f0<\/span><span>The period of interruption in service between the date of dismissal\/removal\/compulsory retirement and the date of reinstatement, AND<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f8\ufe0f<\/span><span>The period of suspension, if any<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>Shall not count as qualifying service unless:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>Regularised as duty or leave by a <strong>specific order<\/strong> of the authority which passed the order of reinstatement<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 17 -->\r\n  <div class=\"rule-heading-block\" id=\"r17\">\r\n    <span class=\"rule-badge\">RULE 17<\/span>\r\n    <h3>Forfeiture of Service on Resignation<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 General Rule on Resignation<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>Resignation from a service or a post entails <strong>forfeiture of past service<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Exception \u2014 Withdrawal of Resignation<\/div>\r\n    <p>Unless it is <strong>allowed to be withdrawn in the public interest<\/strong> by the appointing authority.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Resignation for Another Government Post<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>A resignation shall <strong>not entail forfeiture of past service<\/strong> if:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>It has been submitted to take up, <strong>with proper permission<\/strong>, another appointment (whether temporary or permanent) under the Government where service qualifies<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Interruption Due to Transfer to Different Station<\/h4>\r\n\r\n  <p>Interruption in service in a case falling under sub-rule (2), due to the two appointments being at different stations:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u23f0<\/span><span>Not exceeding the <strong>joining time permissible<\/strong> under the rules of transfer<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span>Shall be covered by grant of <strong>leave of any kind due<\/strong> to the Government servant on the date of relief, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u2705<\/span><span>By <strong>formal condonation<\/strong> by present organisation to the extent to which the period is not covered by leave due to him<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (4) \u2014 Withdrawal of Resignation with Condonation<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcdc<\/span><span>Where an order is passed by the appointing authority under CCS (Implementation of NPS) Rules, 2021, allowing a person to <strong>withdraw his resignation and resume duty<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u2705<\/span><span>The order shall be deemed to include the <strong>condonation of interruption in service<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>But the period of interruption shall <strong>not count as qualifying service<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (5) \u2014 Resignation for Pension Purposes<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>A resignation submitted for the purpose of <strong>rule 32<\/strong> shall not entail forfeiture of past service under the Government<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 18 -->\r\n  <div class=\"rule-heading-block\" id=\"r18\">\r\n    <span class=\"rule-badge\">RULE 18<\/span>\r\n    <h3>Effect of Interruption in Service<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 General Rule and Exceptions<\/h4>\r\n\r\n  <p>An interruption in the service of a Government servant entails <strong>forfeiture of his past service<\/strong>, except in the following cases:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span><strong>(a)<\/strong> Authorised leave of absence<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span><strong>(b)<\/strong> Unauthorised absence in continuation of authorised leave of absence so long as the post of absentee is not filled substantively<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f8\ufe0f<\/span><span><strong>(c)<\/strong> Suspension, where it is immediately followed by reinstatement (whether in the same or a different post), OR where the Government servant dies or is permitted to retire or is retired on attaining the age of compulsory retirement while under suspension<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span><strong>(d)<\/strong> Transfer to non-qualifying service in an establishment under the control of the Government if such transfer has been ordered by a competent authority in the public interest<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\ude97<\/span><span><strong>(e)<\/strong> Joining time while on transfer from one post to another<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Commutation of Absence Without Leave<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Retrospective Commutation<\/div>\r\n    <p>Notwithstanding anything contained in sub-rule (1), the appointing authority may, by order, <strong>commute retrospectively<\/strong> the periods of absence without leave as <strong>extraordinary leave<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 19 -->\r\n  <div class=\"rule-heading-block\" id=\"r19\">\r\n    <span class=\"rule-badge\">RULE 19<\/span>\r\n    <h3>Condonation of Interruption in Service<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Automatic Condonation<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Automatic Condonation Rule<\/div>\r\n    <p>In the absence of a specific indication to the contrary in the service book:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\u2705<\/span><span>An interruption between two spells of civil service rendered by a Government servant under Government (including civil service rendered and paid out of Defence Services Estimates or Railway Estimates) shall be treated as <strong>automatically condoned<\/strong><\/span><\/li>\r\n interruption caused by:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83d\udce4<\/span><span>Resignation<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udeab<\/span><span>Dismissal or removal from service<\/span><\/li>\r\n      <li><span class=\"ico\">\u26d4<\/span><span>Participation in a strike<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (3) \u2014 Non-Counting of Interruption Period<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u23f0<\/span><span>The period of interruption referred to in sub-rule (1) shall <strong>not count as qualifying service<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 20 -->\r\n  <div class=\"rule-heading-block\" id=\"r20\">\r\n    <span class=\"rule-badge\">RULE 20<\/span>\r\n    <h3>Period of Deputation<\/h3>\r\n  <\/div>\r\n\r\n  <p>Service rendered by a Government servant on:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udf0d<\/span><span>Foreign service in India or abroad, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfdb\ufe0f<\/span><span>Deputation to United Nations or other International organisations<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>Shall count as qualifying service for gratuity provided:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span><strong>Contributions in respect of gratuity<\/strong> have been deposited for the said period<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc64<\/span><span>Either by the Government servant himself, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfe2<\/span><span>By the foreign employer<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcda<\/span>\r\n    <span><strong>EXPLANATION:<\/strong> For the purposes of this rule, the rate of contribution for counting of period as qualifying service for the purpose of grant of gratuity shall be regulated in accordance with the <strong>instructions issued by the Department of Personnel and Training<\/strong> from time to time.<\/span>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 21 -->\r\n  <div class=\"rule-heading-block\" id=\"r21\">\r\n    <span class=\"rule-badge\">RULE 21<\/span>\r\n    <h3>Verification of Qualifying Service<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Regular Verification Points<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udcca Verification Timeline<\/div>\r\n    <p>On each occasion:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">1\ufe0f\u20e3<\/span><span>After a Government servant has completed <strong>eighteen years of service<\/strong>, AND<\/span><\/li>\r\n      <li><span class=\"ico\">2\ufe0f\u20e3<\/span><span>On his being left with <strong>five years of service before the date of superannuation<\/strong><\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <p>The Head of Office in consultation with Accounts Officer shall:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>In accordance with the rules for the time being in force, <strong>verify the service<\/strong> rendered by such a Government servant<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcca<\/span><span><strong>Determine the qualifying service<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Communicate to him, <strong>in Form 1<\/strong>, the period of qualifying service so determined<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Special Cases for Early Verification<\/h4>\r\n\r\n  <div class=\"box-keypoints\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Early Verification Cases<\/div>\r\n    <p>Notwithstanding anything contained in sub-rule (1), where a Government servant is:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udd04<\/span><span>Transferred to another Department from a <strong>temporary Department<\/strong>, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udeab<\/span><span>On account of the <strong>closure of the Department<\/strong> he had been previously serving, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udce4<\/span><span>Because the <strong>post he held had been declared surplus<\/strong><\/span><\/li>\r\n    <\/ul>\r\n    <p style=\"margin-top:10px;\">The verification of his service may be done <strong>whenever such event occurs<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (3) \u2014 Finality of Verification<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Final and Binding<\/div>\r\n    <p>The verification done under sub-rules (1) and (2) shall be treated as <strong>final<\/strong> and shall not be reopened except when:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udcdc<\/span><span>Necessitated by a <strong>subsequent change in the rules and orders<\/strong> governing the conditions under which the service qualifies for gratuity<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 CHAPTER V \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 -->\r\n  <div class=\"chapter-heading-block\" id=\"ch5\">\r\n    <span class=\"chapter-badge\">CHAPTER V<\/span>\r\n    <h2>Regulation of Retirement Gratuity and Death Gratuity<\/h2>\r\n  <\/div>\r\n\r\n  <!-- RULE 22 -->\r\n  <div class=\"rule-heading-block\" id=\"r22\">\r\n    <span class=\"rule-badge\">RULE 22<\/span>\r\n    <h3>Retirement Gratuity or Death Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Retirement Gratuity<\/h4>\r\n\r\n  <p>A Government servant, who has completed <strong>five years' qualifying service<\/strong> and who:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udf93<\/span><span><strong>(i)<\/strong> Retires on attaining the age of superannuation, OR on invalidation<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span><strong>(ii)<\/strong> Retires or is retired, in advance of the age of superannuation in accordance with rule 56 of the FR, 1922 or rule 12 of the CCS (Implementation of NPS) Rules, 2021<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span><strong>(iii)<\/strong> On being declared surplus to the establishment, opts for Special Voluntary Retirement Scheme relating to voluntary retirement of surplus employees<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfe2<\/span><span><strong>(iv)<\/strong> Has been permitted to be absorbed in a service or post in or under a Corporation or Company wholly or substantially owned or controlled by the Central Government or a State Government or in or under a body controlled or financed by the Central\/State Government<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udcb0 Retirement Gratuity Formula<\/div>\r\n    <p>Shall, on his retirement, be granted retirement gratuity equal to:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udcca<\/span><span><strong>One-fourth of his emoluments<\/strong> for each completed six monthly period of qualifying service<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udd1d<\/span><span><strong>Maximum:<\/strong> 16\u00bd times the emoluments<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Death Gratuity Rates<\/h4>\r\n\r\n  <p>Where a Government servant dies while in service, the death gratuity shall be payable to his family at the following rates:<\/p>\r\n\r\n  <div class=\"box-definition\">\r\n    <div class=\"box-label\">\ud83d\udcca Death Gratuity Table<\/div>\r\n    <table style=\"width:100%; border-collapse: collapse; margin-top:10px;\">\r\n      <thead>\r\n        <tr    <td style=\"padding:8px; border:1px solid #e8e8e8;\"><strong>Half of emoluments<\/strong> for every completed six-monthly period of qualifying service<br><strong>Maximum: 33 times<\/strong> of emoluments<\/td>\r\n        <\/tr>\r\n      <\/tbody>\r\n    <\/table>\r\n  <\/div>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\ud83d\udcb0 First Proviso \u2014 Maximum Limit<\/div>\r\n    <p>The amount of retirement gratuity or death gratuity payable under this rule shall in no case exceed <strong>twenty lakh rupees (\u20b920,00,000)<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udca1 Second Proviso \u2014 Rounding Off<\/div>\r\n    <p>Where the amount of retirement or death gratuity as finally calculated contains a fraction of a rupee, it shall be <strong>rounded off to the next higher rupee<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (3) \u2014 Emoluments for Gratuity Calculation<\/h4>\r\n\r\n  <p>The emoluments for the purpose of gratuity admissible under this rule, shall be reckoned in accordance with Rule 6.<\/p>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f First Proviso \u2014 Reduced Emoluments<\/div>\r\n    <p>If the emoluments of a Government servant have been <strong>reduced during the last ten months of his service otherwise than as a penalty<\/strong>, average emoluments as referred to in Rule 7 shall be treated as emoluments.<\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udcb0 Second Proviso \u2014 Dearness Allowance<\/div>\r\n    <p>The <strong>dearness allowance admissible on the date of retirement or death<\/strong>, as the case may be, shall also be treated as emoluments for the purpose of this rule.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (4) \u2014 Residuary Gratuity<\/h4>\r\n\r\n  <p>Where a Government servant, who has become eligible for retirement gratuity:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc80<\/span><span>Dies <strong>within five years<\/strong> from the date of his retirement from service (including compulsory retirement as a penalty)<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>AND the sums actually received by him at the time of death on account of annuity under NPS, if any, together with the retirement gratuity are <strong>less than twelve times of his emoluments<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>A residuary gratuity equal to the deficiency may be granted to his family<\/strong> in the manner indicated in sub-rule (1) of rule 24.<\/p>\r\n\r\n  <h4>Sub-rule (5) \u2014 Definition of 'Family'<\/h4>\r\n\r\n  <div class=\"box-definition\">\r\n    <div class=\"box-label\">\ud83d\udc68\u200d\ud83d\udc69\u200d\ud83d\udc67\u200d\ud83d\udc66 'Family' includes:<\/div>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udc70<\/span><span><strong>(i)<\/strong> Wife or wives including judicially separated wife or wives (male Government servant)<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83e\udd35<\/span><span><strong>(ii)<\/strong> Husband, including judicially separated husband (female Government servant)<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc66<\/span><span><strong>(iii)<\/strong> Sons including stepsons and adopted sons<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc67<\/span><span><strong>(iv)<\/strong> Unmarried daughters including stepdaughters and adopted daughters<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc94<\/span><span><strong>(v)<\/strong> Widowed or divorced daughters including stepdaughters and adopted daughters<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc74<\/span><span><strong>(vi)<\/strong> Father, including adoptive parents (where personal law permits adoption)<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc75<\/span><span><strong>(vii)<\/strong> Mother, including adoptive parents (where personal law permits adoption)<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc66<\/span><span><strong>(viii)<\/strong> Brothers below the age of eighteen years including stepbrothers<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc67<\/span><span><strong>(ix)<\/strong> Unmarried sisters and widowed sisters including stepsisters<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc91<\/span><span><strong>(x)<\/strong> Married daughters<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc76<\/span><span><strong>(xi)<\/strong> Children of a pre-deceased son<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcda<\/span>\r\n    <span><strong>EXPLANATION (1):<\/strong> In calculating the length of qualifying service, fraction of a year equal to <strong>three months and above<\/strong> shall be treated as a completed one half-year and reckoned as qualifying service.<\/span>\r\n  <\/div>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcda<\/span>\r\n    <span><strong>EXPLANATION (2):<\/strong> Death gratuity shall also be admissible in the case of a Government servant who <strong>commits suicide<\/strong>.<\/span>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 23 -->\r\n  <div class=\"rule-heading-block\" id=\"r23\">\r\n    <span class=\"rule-badge\">RULE 23<\/span>\r\n    <h3>Nominations<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Making Nomination<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span>A Government servant shall, on his <strong>initial confirmation<\/strong> in a service or post, make a nomination <strong>in Form 2<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc65<\/span><span>Conferring on one or more persons the right to receive the retirement gratuity or death gratuity payable under rule 22<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Provisos \u2014 Nomination Restrictions<\/div>\r\n    <p>If at the time of making the nomination:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udc68\u200d\ud83d\udc69\u200d\ud83d\udc67<\/span><span><strong>(i)<\/strong> The Government servant <strong>has a family<\/strong>, the nomination shall <strong>not be made in favour of any person other than the members of his family<\/strong><\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udeab<\/span><span><strong>(ii)<\/strong> The Government servant <strong>has no family<\/strong>, the nomination may be made in favour of any person or persons, or a body of individuals (whether incorporated or not)<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Multiple Nominees<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Where a Government servant nominates more than one person, he shall <strong>specify the amount of share payable to each nominee<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcca<\/span><span>In such manner as to cover the <strong>entire amount of gratuity<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Special Provisions in Nomination<\/h4>\r\n\r\n  <p>A Government servant may provide in the nomination:<\/p>\r\n\r\n  <p><strong>(i) Alternate Nominee:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>That in respect of any specified nominee who predeceases the Government servant, or who dies after the death of the Government servant but before receiving payment of gratuity<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc64<\/span><span>The right conferred on that nominee shall pass to such other person as may be specified in the nomination<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f First Proviso \u2014 Family with Multiple Members<\/div>\r\n    <p>If at the time of making the nomination the Government servant has a family consisting of more than one member, the person so specified shall <strong>not be a person other than a member of his family<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udca1 Second Proviso \u2014 Family with Single Member<\/div>\r\n    <p>Where a Government servant has only one member in his family, and a nomination has been made in his favour, it is open to the Government servant to <strong>nominate alternate nominee(s) in favour of any person or a body of individuals<\/strong> (whether incorporated or not).<\/p>\r\n  <\/div>\r\n\r\n  <p><strong>(ii) Invalidation Clause:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>That the nomination shall become invalid in the event of the happening of the contingency provided therein<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (4) \u2014 Automatic Invalidation<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u274c<\/span><span>The nomination made by a Government servant who has no family at the time of making it, OR the nomination made under the second proviso to clause (i) of sub-rule (3) where he has only one member in his family<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>Shall become invalid in the event of the Government servant subsequently acquiring a family, or an additional member in the family<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (5) \u2014 Cancellation of Nomination<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u270f\ufe0f<\/span><span>A Government servant may, at any time, cancel a nomination by sending a <strong>notice in writing<\/strong> to the Head of Office<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Fresh Nomination Required<\/div>\r\n    <p>He shall, along with such notice, send a <strong>fresh nomination<\/strong> made in accordance with this rule.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (6) \u2014 Obligation to Update Nomination<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span>Immediately on the death of a nominee (in respect of whom no special provision has been made) OR on the occurrence of any event by reason of which the nomination becomes invalid<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>The Government servant shall send to the Head of Office a notice in writing cancelling the nomination together with a <strong>fresh nomination<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (7) \u2014 Processing of Nominations<\/h4>\r\n\r\n  <p><strong>(a) Submission:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Every nomination made (including every notice of cancellation) shall be sent to the Head of Office<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(b) Verification and Countersigning:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>The Head of Office shall immediately verify that the nomination made is in accordance with the provisions of this rule<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc68\u200d\ud83d\udc69\u200d\ud83d\udc67<\/span><span>If the Government servant has a family, verify that nomination is in favour of one or more members of the family<\/span><\/li>\r\n    <li><span class=\"ico\">\u270d\ufe0f<\/span><span>The Head of Office shall countersign the nomination indicating the date of receipt and keep it under custody<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udca1 Proviso \u2014 Delegation<\/div>\r\n    <p>The Head of Office may authorise his <strong>subordinate Gazetted Officers<\/strong> to countersign nomination forms of non-Gazetted Government servants.<\/p>\r\n  <\/div>\r\n\r\n  <p><strong>(c) Service Book Entry:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcda<\/span><span>Suitable entry regarding receipt of nomination shall be made in the service book of the Government servant concerned<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (8) \u2014 Effective Date of Nomination<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>Every nomination made, and every notice of cancellation given, shall take effect from the <strong>date on which it is received by the Head of Office<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 24 -->\r\n  <div class=\"rule-heading-block\" id=\"r24\">\r\n    <span class=\"rule-badge\">RULE 24<\/span>\r\n    <h3>Persons to Whom Gratuity is Payable<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Order of Priority for Payment<\/h4>\r\n\r\n  <p><strong>(a) First Priority \u2014 Nominees:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc64<\/span><span>The gratuity payable under rule 22 shall be paid to the person(s) on whom the right to receive gratuity is conferred by means of a <strong>nomination under rule 23<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(b) If No Valid Nomination:<\/strong><\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span><strong>(A)<\/strong> If there are one or more surviving members of the family as specified in clauses (i), (ii), (iii), (iv) and (v) of sub-rule (5) of rule 22 (spouse, sons, unmarried daughters, widowed\/divorced daughters), to <strong>all such members in equal shares<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span><strong>(B)<\/strong> If there are no such surviving members as specified in (A), but there are one or more members as specified in clauses (vi), (vii), (viii), (ix), (x) and (xi) of sub-rule (5) of rule 22 (parents, minor brothers, unmarried\/widowed sisters, married daughters, grandchildren), to <strong>all such members in equal shares<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Death After Retirement<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc80<\/span><span>If a Government servant dies after retirement without receiving the gratuity admissible under sub-rule (1) of rule 22<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc68\u200d\ud83d\udc69\u200d\ud83d\udc67<\/span><span>The gratuity shall be disbursed to the family in the manner provided in sub-rule (1)<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Rights Not Affected by Marriage or Age<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Protection of Rights<\/div>\r\n    <p>The right of a female member of the family, or that of a brother, to receive the share of gratuity shall <strong>not be affected<\/strong> if:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udc91<\/span><span>The female member marries or re-marries after the death of the Government servant and before receiving her share, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83c\udf82<\/span><span>The brother attains the age of eighteen years after the death and before receiving his share<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (4) \u2014 Payment to Minor<\/h4>\r\n\r\n  <p>Where gratuity is granted to a minor member of the family of the deceased Government servant:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc76<\/span><span>It shall be payable to the <strong>guardian on behalf of the minor<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcda<\/span>\r\n    <span><strong>EXPLANATION (1):<\/strong> Payment of the minor's share shall be made to the <strong>natural guardian<\/strong> of the minor, if any. In the absence of a natural guardian, payment shall be made to the person who furnishes a <strong>certificate of guardianship<\/strong>.<\/span>\r\n  <\/div>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcb0<\/span>\r\n    <span><strong>EXPLANATION (2):<\/strong> In the absence of a natural guardian, payment of <strong>twenty per cent of minor's share<\/strong> may be made to the guardian without production of a guardianship certificate but on production of an <strong>indemnity bond in Proforma A<\/strong>. The balance amount may be paid on production of the certificate of guardianship.<\/span>\r\n  <\/div>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcca<\/span>\r\n    <span><strong>EXPLANATION (3):<\/strong> The share of gratuity payable to a member of the family who has died or become disqualified before receiving actual payment, shall be <strong>distributed equally among the remaining members of the family<\/strong> in accordance with clause (b) of sub-rule (1).<\/span>\r\n  <\/div>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\u2705<\/span>\r\n    <span><strong>EXPLANATION (4):<\/strong> Disbursing authorities shall ascertain, before making actual payment, whether all members of the family in whose favour the sanction was issued have continued to be qualified. If not, or if any of them is dead, the fact shall be reported immediately to the sanctioning authority for the issue of a <strong>revised sanction<\/strong>.<\/span>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 25 -->\r\n  <div class=\"rule-heading-block\" id=\"r25\">\r\n    <span class=\"rule-badge\">RULE 25<\/span>\r\n    <h3>Debarring a Person from Receiving Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Suspension of Claim<\/h4>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Murder Charge \u2014 Suspension of Payment<\/div>\r\n    <p>Where a person who is eligible to receive gratuity is <strong>charged with the offence of murdering the Government servant or for abetting in the commission of such an offence<\/strong>:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\u23f8\ufe0f<\/span><span>His claim to receive his share of gratuity shall remain <strong>suspended till the conclusion of the criminal proceedings<\/strong> instituted against him<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 After Conclusion of Criminal Proceedings<\/h4>\r\n\r\n  <p><strong>(a) If Convicted:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>Is convicted for the murder or abetting in the murder, he shall be <strong>debarred from receiving his share of gratuity<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc68\u200d\ud83d\udc69\u200d\ud83d\udc67<\/span><span>Which shall be payable to <strong>other eligible members of the family<\/strong>, if any<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(b) If Acquitted:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>Is acquitted of the charge, <strong>his share of gratuity shall be payable to him<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Applicability to Undisbursed Gratuity<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The provisions of sub-rule (1) and sub-rule (2) shall also apply to the <strong>undisbursed gratuity<\/strong> referred to in sub-rule (2) of rule 24<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 26 -->\r\n  <div class=\"rule-heading-block\" id=\"r26\">\r\n    <span class=\"rule-badge\">RULE 26<\/span>\r\n    <h3>Lapse of Retirement Gratuity or Death Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <p>Where a Government servant dies while in service or after retirement without receiving the amount of gratuity and:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc68\u200d\ud83d\udc69\u200d\ud83d\udc67<\/span><span>Leaves behind <strong>no family<\/strong>, AND<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span><strong>(a)<\/strong> Has made no nomination, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u274c<\/span><span><strong>(b)<\/strong> The nomination made by him does not subsist<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\ud83c\udfdb\ufe0f Lapse to Government<\/div>\r\n    <p>The amount of retirement gratuity or death gratuity payable shall <strong>lapse to the Government<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2696\ufe0f Proviso \u2014 Succession Certificate<\/div>\r\n    <p>The amount shall be payable to the person in whose favour a <strong>Succession Certificate<\/strong> in respect of the gratuity in question has been granted by a Court of Law.<\/p>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 27 -->\r\n  <div class=\"rule-heading-block\" id=\"r27\">\r\n    <span class=\"rule-badge\">RULE 27<\/span>\r\n    <h3>Superannuation Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udf93<\/span><span>A superannuation gratuity shall be granted in accordance with rule 22 to a Government servant who is retired on his <strong>attaining the age of superannuation<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>OR, if the service has been extended beyond superannuation, on <strong>expiry of such period of extension<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 28 -->\r\n  <div class=\"rule-heading-block\" id=\"r28\">\r\n    <span class=\"rule-badge\">RULE 28<\/span>\r\n    <h3>Invalid Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <p>An Invalid Gratuity shall be granted in accordance with rule 22 to a Government servant who:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfe5<\/span><span>Retires from service on account of any <strong>bodily or mental infirmity<\/strong> which permanently incapacitates him for the service<\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>In accordance with rule 16 of the CCS (Implementation of NPS) Rules, 2021<\/span><\/li>\r\n    <li><span class=\"ico\">\u2705<\/span><span>Who had exercised option or in whose case the default option under rule 10 is for availing benefits under <strong>National Pension System<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Old Pension Optees<\/div>\r\n    <p>Where a Government servant had exercised option or default option under rule 10 of the CCS (Implementation of NPS) Rules, 2021 is for availing benefits under:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udcdc<\/span><span>CCS (Pension) Rules, 1972, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcdc<\/span><span>CCS (Extraordinary Pension) Rules, 1939<\/span><\/li>\r\n    <\/ul>\r\n    <p style=\"margin-top:10px;\">And in whose case the provision of section 20 of the Rights of Persons with Disabilities Act, 2016 are not applicable:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>Further action will be taken by the Head of Office for disbursement of benefits in accordance with the CCS (Pension) Rules, 1972 or CCS (Extraordinary Pension) Rules, 1939<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 29 -->\r\n  <div class=\"rule-heading-block\" id=\"r29\">\r\n    <span class=\"rule-badge\">RULE 29<\/span>\r\n    <h3>Retiring Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <p>A Government servant who:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Retires or is retired, in advance of the age of superannuation in accordance with rule 56 of the FR, 1922 or rule 12 of the CCS (Implementation of NPS) Rules, 2021<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>On being declared surplus to the establishment<\/span><\/li>\r\n    <li><span class=\"ico\">\u2705<\/span><span>Opts for Special Voluntary Retirement Scheme for surplus employees notified by DoPT vide O.M. No. 25013\/6\/2001-Estt.(A), dated 28th February, 2002 (as amended)<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>Shall be entitled to gratuity admissible under rule 22.<\/strong><\/p>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 30 -->\r\n  <div class=\"rule-heading-block\" id=\"r30\">\r\n    <span class=\"rule-badge\">RULE 30<\/span>\r\n    <h3>Gratuity on Compulsory Retirement<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Minimum Gratuity<\/h4>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\u2696\ufe0f Compulsory Retirement as Penalty<\/div>\r\n    <p>A Government servant compulsorily retired from service as a penalty may be granted, by the authority competent to impose such penalty:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Gratuity at a rate <strong>not less than two-thirds<\/strong> of gratuity admissible to him on the date of his compulsory retirement<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 UPSC Consultation<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Mandatory Consultation<\/div>\r\n    <p>Whenever in the case of a Government servant the President passes an order (whether original, appellate or in exercise of power of review) awarding a gratuity <strong>less than the full gratuity<\/strong> admissible under these rules:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83c\udfdb\ufe0f<\/span><span>The <strong>Union Public Service Commission shall be consulted<\/strong> before such order is passed<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 31 -->\r\n  <div class=\"rule-heading-block\" id=\"r31\">\r\n    <span class=\"rule-badge\">RULE 31<\/span>\r\n    <h3>Effect of Dismissal or Removal<\/h3>\r\n  <\/div>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\ud83d\udeab Forfeiture on Dismissal\/Removal<\/div>\r\n    <p>A Government servant who is dismissed or removed from service shall <strong>forfeit his gratuity<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udca1 Proviso \u2014 Compassionate Gratuity<\/div>\r\n    <p>The authority competent to dismiss or remove him from service may, if the case is <strong>deserving of special consideration<\/strong>, sanction a compassionate gratuity:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span><strong>Not exceeding two-thirds<\/strong> of retirement gratuity calculated at the rates mentioned in sub-rule (1) of rule 22<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 32 -->\r\n  <div class=\"rule-heading-block\" id=\"r32\">\r\n    <span class=\"rule-badge\">RULE 32<\/span>\r\n    <h3>Benefit on Absorption in Corporation, Company or Body<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Deemed Retirement on Absorption<\/h4>\r\n\r\n  <p>A Government servant who has been permitted to be absorbed in a service or post in or under:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfe2<\/span><span>A corporation or company wholly or substantially owned or controlled by the Central Government or a State Government, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfdb\ufe0f<\/span><span>A body controlled or financed by the Central Government or a State Government<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>Shall be deemed to have retired from service from the date of such absorption and:<\/strong><\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>Subject to sub-rule (4), he shall be eligible, on such absorption, to receive <strong>retirement gratuity<\/strong> on the basis of the qualifying service and emoluments on the date of absorption in accordance with rule 22<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udcb0 Proviso \u2014 Maximum Limit on Total Gratuity<\/div>\r\n    <p>On retirement from such corporation or company or body, the <strong>total amount of gratuity<\/strong> in respect of:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>The service rendered under the Government, AND<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83c\udfe2<\/span><span>The service rendered in such corporation or company or body<\/span><\/li>\r\n    <\/ul>\r\n    <p style=\"margin-top:10px;\">Shall <strong>not exceed<\/strong> the amount that would have been admissible had the Government servant continued in Government service and retired on the same pay which he drew on retirement from that corporation or company or body.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Joint Sector Undertakings<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83e\udd1d<\/span><span>The provisions of sub-rule (1) shall also apply to Central Government servants who are permitted to be absorbed in <strong>joint sector undertakings<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Wholly under the joint control of Central Government and State Governments or Union territory Administrations OR under the joint control of two or more State Governments or Union territory Administrations<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Immediate Absorption Procedure<\/h4>\r\n\r\n  <p><strong>(a) Relieving Order:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc4<\/span><span>Where a Government employee joins a corporation or company or body on immediate absorption basis, the relieving order shall be issued <strong>in Form 3<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>The relieving order shall indicate the period within which the Government servant shall join<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u23f0 Proviso \u2014 Extension of Joining Time<\/div>\r\n    <p>This period may be <strong>extended by the relieving authority<\/strong> for reasons beyond the control of the Government servant, which shall be recorded in writing.<\/p>\r\n  <\/div>\r\n\r\n  <p><strong>(b) Regularisation of Gap Period:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span>The period between the date of relief and the date of joining may be regularised by grant of leave due<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>If no such leave is due, the period may be regularised by grant of extraordinary leave<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(c) Ascertainment of Joining Date:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>The relieving authority, before processing the case for sanction of retirement benefits, shall ascertain the date of joining by the Government servant<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Accept the resignation of the Government servant from the date preceding the date of joining<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(d) Severance of Connection:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>No lien of the Government servant shall be retained in the relieving Department<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>All his connections with the Government shall stand severed on his absorption<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (4) \u2014 Option Where Similar Gratuity Scheme Exists<\/h4>\r\n\r\n  <p>Where a gratuity scheme similar to the gratuity scheme under these rules exists in a body controlled or financed by the Central Government or a State Government:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>He shall be entitled to exercise option either:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span><strong>(a)<\/strong> To receive retirement benefits for the service rendered under the Central Government in accordance with sub-rule (1), OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcca<\/span><span><strong>(b)<\/strong> To count the service rendered under the Central Government in that body for pension<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (5) \u2014 Capitalised Value Payment<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Where a Government servant is absorbed in a body and exercises option under clause (b) of sub-rule (4)<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The Government shall discharge its gratuity liability by paying <strong>in lump sum as a one time payment<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcca<\/span><span>The gratuity liability shall be the <strong>capitalised value of retirement gratuity<\/strong> for the service up to the date of absorption<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (6) \u2014 Date of Absorption<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>The date of absorption shall be determined in accordance with the provisions of rule 15 of the CCS (Implementation of NPS) Rules, 2021<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcda<\/span>\r\n    <span><strong>EXPLANATION:<\/strong> For the purpose of this rule, the expression 'body' means an <strong>autonomous body or a statutory body<\/strong>.<\/span>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 33 -->\r\n  <div class=\"rule-heading-block\" id=\"r33\">\r\n    <span class=\"rule-badge\">RULE 33<\/span>\r\n    <h3>Payment of Gratuity in Case of Missing Government Servant<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Police Complaint<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc6e<\/span><span>Where a Government servant is missing, the family shall lodge a complaint with the <strong>concerned police station<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Obtain report from the police that the Government servant has not been traced despite all efforts<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc4<\/span><span>The report may be the First Information Report or any other report such as Daily Diary or General Diary Entry<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Application for Gratuity<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u23f0<\/span><span>The family <strong>after six months<\/strong> of lodging police complaint may apply <strong>in Form 4<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>For the grant of retirement gratuity to the Head of Office of the organisation where the Government servant had last served<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Sanction Formalities<\/h4>\r\n\r\n  <p>The retirement gratuity may be sanctioned by the concerned Ministry or Department after observing the following formalities:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span><strong>(i)<\/strong> Ensure that the complaint lodged with the police and non-traceable report given by the police is correct<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc4<\/span><span><strong>(ii)<\/strong> An Indemnity bond <strong>in Proforma-B<\/strong> shall be taken from the nominee or dependents<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>That the retirement gratuity shall be adjusted against the payment due to the Government servant in case he appears on the scene and makes any claim<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (4) \u2014 Processing and Payment<\/h4>\r\n\r\n  <p><strong>(a) Processing:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The Head of Office shall process the case <strong>in Form 5<\/strong> for grant of retirement gratuity<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(b) Timeline and Interest:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u23f0<\/span><span>The retirement gratuity shall be paid to the family <strong>within three months<\/strong> of the date of application<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>In case of any delay, the <strong>interest shall be paid at the applicable Public Provident Fund rates<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Responsibility for delay shall be fixed in accordance with rule 44<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(c) Difference Between Death and Retirement Gratuity:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The difference between the death gratuity and retirement gratuity shall be payable after:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udc80<\/span><span>The death of the employee is conclusively established, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>On the expiry of the period of <strong>seven years from the date of the police report<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (5) \u2014 Recovery of Government Dues<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>The Head of Office shall assess all the <strong>Government dues outstanding<\/strong> against the Government servant<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Effect their recovery in accordance with rule 45 before sanctioning the payment of gratuity<\/span><\/li>\r\n  <\/ul>\r\n<hr class=\"section-divider\">\r\n\r\n  <!-- \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 CHAPTER <div class=\"chapter-heading-block\" id=\"ch6\">\r\n    <span class=\"chapter-badge\">CHAPTER VI<\/span>\r\n    <h2>Determination and Authorisation of the Amount of Gratuity<\/h2>\r\n  <\/div>\r\n\r\n  <!-- RULE 34 -->\r\n  <div class=\"rule-heading-block\" id=\"r34\">\r\n    <span class=\"rule-badge\">RULE 34<\/span>\r\n    <h3>Preparation of Papers for Payment of Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u23f0 Timeline for Preparation<\/div>\r\n    <p>Every Head of Office shall undertake the work of preparation of papers for grant of gratuity <strong>in Form 6<\/strong>:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udcc5<\/span><span><strong>One year before<\/strong> the date on which a Government servant is due to retire on superannuation, OR<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span>On the date on which he proceeds on leave preparatory to retirement<\/span><\/li>\r\n      <li><span class=\"ico\">\u2705<\/span><span><strong>Whichever is earlier<\/strong><\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 35 -->\r\n  <div class=\"rule-heading-block\" id=\"r35\">\r\n    <span class=\"rule-badge\">RULE 35<\/span>\r\n    <h3>Intimation to Directorate of Estates Regarding 'No Demand Certificate'<\/h3>\r\n  <\/div>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span>The Head of Office shall write to the <strong>Directorate of Estates<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>At least <strong>one year before<\/strong> the anticipated date of retirement<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfe0<\/span><span>For Government servant who was or is in occupation of a Government accommodation (allottee)<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>For issuing a <strong>'No Demand Certificate'<\/strong> in respect of the period preceding eight months of the retirement<\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>In accordance with rule 22 of the CCS (Implementation of NPS) Rules, 2021<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 36 -->\r\n  <div class=\"rule-heading-block\" id=\"r36\">\r\n    <span class=\"rule-badge\">RULE 36<\/span>\r\n    <h3>Stages for Completion of Papers for Payment of Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Three Stages<\/h4>\r\n\r\n  <p>The Head of Office shall divide the period of preparatory work of one year into the following three stages:<\/p>\r\n\r\n  <h4>(a) First Stage \u2014 Verification of Service<\/h4>\r\n\r\n  <p><strong>(i) Initial Verification:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcda<\/span><span>The Head of Office shall go through the service book and verify whether certificates of verification for service subsequent to the service verified under rule 21 are recorded<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(ii) Unverified Service:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>For unverified portion(s) of service, verify based on pay bills, acquittance rolls or other relevant records<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc4<\/span><span>Such as last pay certificate, pay slip for month of April (which shows verification for previous financial year)<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span>Record necessary certificates in the service book<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(iii) Service in Another Office\/Department:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Where service for any period is not capable of being verified and was rendered in another office or Department<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>The present Head of Office shall refer the said period to the Head of Office where the Government servant served during that period<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(iv) Response from Other Office:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>On receipt of communication, that Head of Office shall verify the service and send necessary certificates<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>Within <strong>two months<\/strong> from the date of receipt of reference<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Incapable of Verification<\/div>\r\n    <p>In case a period of service is incapable of being verified, it shall be brought to the notice of the referring Head of Office simultaneously.<\/p>\r\n  <\/div>\r\n\r\n  <p><strong>(v) Deemed to Qualify:<\/strong><\/p>\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Automatic Qualification<\/div>\r\n    <p>Where no response is received within the time period referred to in sub-clause (iv), such period or periods shall be <strong>deemed to qualify for gratuity<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <p><strong>(vi) Fixing Responsibility:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Where it is found that the Head of Office and other concerned authorities had failed to communicate any non-qualifying period of service<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The <strong>Secretary of the administrative Ministry or Department<\/strong> shall fix responsibility for such non-communication<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(vii) Completion Timeline:<\/strong><\/p>\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u23f0 Completion Deadline<\/div>\r\n    <p>The process specified in sub-clauses (i) to (v) shall be completed <strong>eight months before the date of superannuation<\/strong> of the Government servant.<\/p>\r\n  <\/div>\r\n\r\n  <p><strong>(viii) Written Statement by Government Servant:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span>Where any portion of service is not capable of being verified in the manner specified above<\/span><\/li>\r\n    <li><span class=\"ico\">\u270d\ufe0f<\/span><span>The Government servant shall be asked to file a <strong>written statement on plain paper within a month<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Stating that he had in fact rendered service for that period<\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>With a declaration as to the truth of that statement<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(ix) Admission of Service:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>The Head of Office shall, after taking into consideration the facts in the written statement, admit that portion of service as having been rendered<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(x) False Information:<\/strong><\/p>\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\ud83d\udeab Grave Misconduct<\/div>\r\n    <p>Where a Government servant is found to have given any <strong>incorrect information willfully<\/strong>, which makes him\/her entitled to any benefits which he\/she is not otherwise entitled to, it shall be construed as a <strong>grave misconduct<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <h4>(b) Second Stage \u2014 Making Good Omissions in Service Book<\/h4>\r\n\r\n  <p><strong>(i) Identify Omissions:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udd0d<\/span><span>The Head of Office while scrutinising the certificates shall identify any omissions, imperfections or deficiencies<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcca<\/span><span>Which have a direct bearing on the determination of emoluments and qualifying service for gratuity<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(ii) Complete Verification:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>Every effort shall be made to complete the verification of service and make good the omissions, imperfections or deficiencies<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(iii) Incapable of Being Made Good:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u274c<\/span><span>Any omission, imperfection or deficiency which is incapable of being made good shall be ignored<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Service qualifying for gratuity shall be determined on the basis of the entries in the service book<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(iv) Verification of Emoluments:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>For calculation of average emoluments, verify from the service book the correctness of emoluments drawn or to be drawn during the <strong>last ten months of service<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(v) Period of Emoluments Verification:<\/strong><\/p>\r\n  <div class=\"box-keypoints\">\r\n    <div class=\"box-label\">\u23f0 Verification Period Limit<\/div>\r\n    <p>To ensure emoluments during the last ten months have been correctly shown, the Head of Office may verify the correctness of emoluments only for the period of <strong>twenty-four months<\/strong> preceding the date of retirement, and not for any period prior to that date.<\/p>\r\n  <\/div>\r\n\r\n  <h4>(c) Third Stage \u2014 Certificate to Retiring Government Servant<\/h4>\r\n\r\n  <p>As soon as the second stage is completed, but not later than <strong>eight months prior<\/strong> to the date of retirement:<\/p>\r\n\r\n  <p><strong>(i) Furnish Certificate:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Furnish to the retiring Government servant a certificate regarding:<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>The length of qualifying service proposed to be admitted for gratuity<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The emoluments and average emoluments proposed to be reckoned for retirement gratuity<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(ii) Opportunity for Objection:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span>Direct the retiring Government servant to furnish reasons for non-acceptance, supported by relevant documents<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>Within <strong>two months<\/strong> if the certified service and emoluments are not acceptable<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 37 -->\r\n  <div class=\"rule-heading-block\" id=\"r37\">\r\n    <span class=\"rule-badge\">RULE 37<\/span>\r\n    <h3>Completion of Part I of Form 6<\/h3>\r\n  <\/div>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span><strong>Superannuation cases:<\/strong> The Head of Office shall complete Part I of Form 6 not later than <strong>four months before<\/strong> the date of retirement<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span><strong>Other retirement cases:<\/strong> Complete Part I of Form 6 <strong>within two months after retirement<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 38 -->\r\n  <div class=\"rule-heading-block\" id=\"r38\">\r\n    <span class=\"rule-badge\">RULE 38<\/span>\r\n    <h3>Forwarding of Forms to Accounts Officer<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Documents to be Forwarded<\/h4>\r\n\r\n  <p>After complying with rules 36 and 37, the Head of Office shall forward:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcc4<\/span><span><strong>Form 6<\/strong> duly completed<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>A covering letter <strong>in Form 7<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcda<\/span><span>Service book of the Government servant duly completed, up to date<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcce<\/span><span>Any other documents relied upon for the verification of service<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>To the <strong>Accounts Officer<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Retention of Copy<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The Head of Office shall retain a copy of Form 6 and Form 7 for his record<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Timeline for Forwarding<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u23f0 Forwarding Timeline<\/div>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udcc5<\/span><span><strong>Superannuation:<\/strong> Not later than <strong>four months before<\/strong> the date of superannuation<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udce4<\/span><span><strong>Other retirements:<\/strong> Not later than <strong>two months after<\/strong> the date of retirement<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 39 -->\r\n  <div class=\"rule-heading-block\" id=\"r39\">\r\n    <span class=\"rule-badge\">RULE 39<\/span>\r\n    <h3>Intimation Regarding Any Event Having Bearing on Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Where after the Forms for payment of gratuity have been forwarded to the Accounts Officer<\/span><\/li>\r\n    <li><span class=\"ico\">\u26a0\ufe0f<\/span><span>Any event occurs which has a bearing on the amount of gratuity admissible<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>The fact shall be <strong>promptly reported<\/strong> to the Accounts Officer by the Head of Office<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 40 -->\r\n  <div class=\"rule-heading-block\" id=\"r40\">\r\n    <span class=\"rule-badge\">RULE 40<\/span>\r\n    <h3>Intimation of Particulars of Government Dues<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Initial Intimation<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>The Head of Office shall, after ascertaining and assessing the Government dues referred to in rule 45<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Furnish the particulars thereof to the Accounts Officer <strong>in Form 7<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Additional Dues<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Where after the particulars of Government dues have been intimated, any additional Government dues come to notice<\/span><\/li>\r\n    <li><span class=\"ico\">\u26a1<\/span><span>Such dues shall be <strong>promptly reported<\/strong> to the Accounts Officer<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 41 -->\r\n  <div class=\"rule-heading-block\" id=\"r41\">\r\n    <span class=\"rule-badge\">RULE 41<\/span>\r\n    <h3>Provisional Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 When Provisional Gratuity is Sanctioned<\/h4>\r\n\r\n  <p>Where in spite of following the procedure laid down in rule 36:<\/p>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u23f0<\/span><span>It is not possible to forward Forms for gratuity within the period specified, OR<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>Forms have been forwarded but the Accounts Officer has returned them for eliciting further information<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>AND the Government servant is likely to retire before gratuity can be finally assessed<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>The Head of Office shall:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Rely upon such information as may be available in the official records<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Without delay, determine the amount of <strong>provisional retirement gratuity<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Other Retirements<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>In case of retirement otherwise than on superannuation<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>The Head of Office shall sanction provisional retirement gratuity <strong>within two months<\/strong> till final assessment<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Sanction and Payment Procedure<\/h4>\r\n\r\n  <p>Where the amount of gratuity cannot be determined for reasons other than Departmental or Judicial proceedings:<\/p>\r\n\r\n  <p><strong>(a) Letter of Sanction:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcdd<\/span><span>Issue a letter of sanction addressed to the Accounts Officer (copy to Government servant)<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Authorising <strong>hundred per cent of the gratuity as provisional gratuity<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udd12<\/span><span>Withholding of <strong>ten per cent of gratuity<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(b) Deductions and Drawing:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Specify in the letter the amount recoverable from gratuity under sub-rule (1) of rule 40<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Draw the amount of provisional gratuity after deducting the amount specified in clause (a) and the dues specified in rule 45<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcca<\/span><span>In the same manner as pay and allowances are drawn<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (4) \u2014 Revision<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>The amount of gratuity payable under sub-rule (2) or (3) shall, if necessary, be revised on completion of detailed scrutiny<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (5) \u2014 Final Settlement Within Six Months<\/h4>\r\n\r\n  <p><strong>(a) Within Six Months:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>If the final amount has been determined by the Head of Office in consultation with Accounts Officer before expiry of six months from retirement<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>The Accounts Officer shall direct the Head of Office to draw and disburse the difference<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>After adjusting Government dues which may have come to notice after payment of provisional gratuity<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(b) Excess Payment:<\/strong><\/p>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udca1 Important \u2014 Excess Payment Protection<\/div>\r\n    <p><strong>(i)<\/strong> Where the provisional gratuity disbursed is more than the amount finally assessed, the retired Government servant shall <strong>not be required to refund the excess amount<\/strong> actually disbursed to him.<\/p>\r\n    <p style=\"margin-top:10px;\"><strong>(ii)<\/strong> The Head of Office shall ensure that chances of disbursing excess amount are minimised and the officials responsible for excess payment shall be <strong>accountable for the overpayment<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (6) \u2014 After Six Months<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Automatic Finalization<\/div>\r\n    <p>Where final amount has not been determined within six months, the Accounts Officer shall <strong>treat the provisional gratuity as final<\/strong> and issue authority order immediately on expiry of the period of six months.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (7) \u2014 Release of Withheld Amount<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>On issue of authority order, the Head of Office shall release the amount of withheld gratuity under clause (a) of sub-rule (3)<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>After adjusting Government dues which may have come to notice after payment of provisional gratuity<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (8) \u2014 Government Accommodation Allottees<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfe0<\/span><span>Where a Government servant is or was an allottee of Government accommodation<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The withheld amount shall be paid on receipt of <strong>'No Demand Certificate'<\/strong> from the Directorate of Estates<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 42 -->\r\n  <div class=\"rule-heading-block\" id=\"r42\">\r\n    <span class=\"rule-badge\">RULE 42<\/span>\r\n    <h3>Authorisation of Gratuity by Accounts Officer<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Processing by Accounts Officer<\/h4>\r\n\r\n  <p><strong>(a) Superannuation:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2705<\/span><span>On receipt of Forms, the Accounts Officer shall apply requisite checks<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Record the account enfacement in Part II of Form 6<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Assess the amount of gratuity<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>Issue authority letter <strong>not later than one month in advance<\/strong> of the date of retirement on attaining superannuation<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <p><strong>(b) Other Retirements:<\/strong><\/p>\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcca<\/span><span>Apply requisite checks, complete Part II of Form 6, assess amount and dues<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>Issue authority letter <strong>within three months<\/strong> of the date of receipt of Forms from Head of Office<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Intimation to Head of Office<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udce4<\/span><span>The amount determined shall be intimated to the Head of Office<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>With remarks that the amount may be drawn by preferring a bill to the Pay and Accounts Officer<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>And disbursed after adjusting Government dues, if any, referred to in rule 45<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Adjustment of Withheld Amount<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The amount of gratuity withheld under sub-rule (5) of rule 46 shall be adjusted against outstanding licence fee<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Intimated by the Directorate of Estates<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb5<\/span><span>The balance, if any, refunded to the retired Government servant<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 43 -->\r\n  <div class=\"rule-heading-block\" id=\"r43\">\r\n    <span class=\"rule-badge\">RULE 43<\/span>\r\n    <h3>Government Servants on Deputation<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Deputation to Another Central Government Department<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udd04<\/span><span>In case of Government servant who retires while on deputation to another Central Government Department<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udc54<\/span><span>Action to authorise gratuity shall be taken by the <strong>Head of Office of the borrowing Department<\/strong><\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Deputation to State Government or Foreign Service<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udf0d<\/span><span>In case of retirement while on deputation to a State Government or while on foreign service<\/span><\/li>\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Action shall be taken by the <strong>Head of Office or Cadre authority<\/strong> which sanctioned deputation<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 44 -->\r\n  <div class=\"rule-heading-block\" id=\"r44\">\r\n    <span class=\"rule-badge\">RULE 44<\/span>\r\n    <h3>Interest on Delayed Payment of Gratuity<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 When Interest is Payable<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\ud83d\udcb0 Interest on Delay<\/div>\r\n    <p>In all cases where payment of gratuity has been authorised later than the date when its payment becomes due:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\u23f0<\/span><span>Including cases of retirement otherwise than on superannuation<\/span><\/li>\r\n      <li><span class=\"ico\">\u2705<\/span><span>AND it is clearly established that delay was attributable to administrative reasons or lapses<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb5<\/span><span>Interest shall be paid at the rate and manner applicable to <strong>Public Provident Fund<\/strong> amount<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Proviso \u2014 Employee's Failure<\/div>\r\n    <p>Provided that the delay in payment was <strong>not caused on account of failure<\/strong> on the part of the Government servant to comply with the procedure laid down by the Government.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Consideration by Secretary<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Every case of delayed payment shall be considered by the <strong>Secretary of the Ministry or Department<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u2705<\/span><span>Where the Secretary is satisfied that delay was caused on account of administrative reasons or lapse<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The Secretary shall sanction payment of interest<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Presidential Sanction<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfdb\ufe0f<\/span><span>The concerned Ministry or Department shall issue <strong>Presidential sanction<\/strong> for payment of interest<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>After the Secretary has sanctioned the payment of interest under sub-rule (2)<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (4) \u2014 Fixing Responsibility<\/h4>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\u2696\ufe0f Disciplinary Action<\/div>\r\n    <p>In all cases where payment of interest has been sanctioned:<\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udd0d<\/span><span>The Ministry or Department shall <strong>fix the responsibility<\/strong><\/span><\/li>\r\n      <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Take <strong>disciplinary action<\/strong> against Government servant(s) found responsible for delay due to administrative lapses<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Explanation (1) \u2014 Superannuation Delay<\/h4>\r\n\r\n  <div class=\"box-explanation\">\r\n    <span class=\"ico\">\ud83d\udcda<\/span>\r\n    <span><strong>EXPLANATION (1):<\/strong> Where payment of retirement gratuity has been delayed beyond <strong>three months from the date of retirement on superannuation<\/strong>, interest at the rate applicable to Public Provident Fund deposits from time to time shall be paid.<\/span>\r\n  <\/div>\r\n\r\n  <h4>Explanation (2) \u2014 Determination of Delay and Interest<\/h4>\r\n\r\n  <div class=\"box-keypoints\">\r\n    <div class=\"box-label\">\ud83d\udcca Interest Calculation in Different Scenarios<\/div>\r\n    \r\n    <p><strong>(i) Disciplinary or Judicial Proceedings Pending:<\/strong><\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\u2705<\/span><span><strong>(a) Fully exonerated:<\/strong> Interest may be allowed beyond 3 months from date of retirement if payment authorized after 3 months from retirement<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udc80<\/span><span><strong>(b) Death during proceedings:<\/strong> Interest may be allowed for delay beyond 3 months from date of death if payment authorized after 3 months from death<\/span><\/li>\r\n      <li><span class=\"ico\">\u2696\ufe0f<\/span><span><strong>(c) Not fully exonerated but gratuity allowed:<\/strong> Interest may be allowed for delay beyond 3 months from date of issue of orders by competent authority<\/span><\/li>\r\n    <\/ul>\r\n\r\n    <p style=\"margin-top:12px;\"><strong>(ii) Retirement Other Than Superannuation:<\/strong><\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>Under clause (j) or (k) of rule 56 of FR, 1922 or rules 12, 13, 16, 17 or 18 of CCS (Implementation of NPS) Rules, 2021<\/span><\/li>\r\n      <li><span class=\"ico\">\u23f0<\/span><span>Where payment delayed beyond <strong>six months from retirement<\/strong>, interest payable for delay beyond 6 months<\/span><\/li>\r\n    <\/ul>\r\n\r\n    <p style=\"margin-top:12px;\"><strong>(iii) Death While in Service:<\/strong><\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83d\udc80<\/span><span>Where payment delayed beyond <strong>six months from death<\/strong>, interest payable for delay beyond 6 months<\/span><\/li>\r\n      <li><span class=\"ico\">\u26a0\ufe0f<\/span><span>If payment held up due to multiple claimants, such cases shall not automatically qualify for interest<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>These shall be decided in consultation with the Department of Pension and Pensioners' Welfare<\/span><\/li>\r\n    <\/ul>\r\n\r\n    <p style=\"margin-top:12px;\"><strong>(iv) Enhancement of Gratuity:<\/strong><\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83d\udcca<\/span><span>Where gratuity enhanced on account of revision of emoluments or change in policy<\/span><\/li>\r\n      <li><span class=\"ico\">\u23f0<\/span><span>Where payment of difference delayed beyond <strong>three months from date of issue of revision orders<\/strong><\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Interest may be allowed for delay beyond 3 months from date of issue of orders<\/span><\/li>\r\n    <\/ul>\r\n\r\n    <p style=\"margin-top:12px;\"><strong>(v) Absorption in PSU or Autonomous Body:<\/strong><\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83c\udfe2<\/span><span>Where Government servant permanently absorbed (otherwise than on en masse transfer)<\/span><\/li>\r\n      <li><span class=\"ico\">\u23f0<\/span><span>Where payment delayed beyond <strong>six months from absorption<\/strong><\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Interest may be allowed for delay beyond 6 months from date of absorption<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 45 -->\r\n  <div class=\"rule-heading-block\" id=\"r45\">\r\n    <span class=\"rule-badge\">RULE 45<\/span>\r\n    <h3>Recovery and Adjustment of Government Dues<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Duty of Head of Office<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>It shall be the duty of the Head of Office to <strong>ascertain and assess Government dues<\/strong> payable by a Government servant due for retirement<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (2) \u2014 Adjustment Against Gratuity<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The Government dues which remain outstanding till the date of retirement shall be <strong>adjusted against the amount of retirement gratuity<\/strong> becoming payable<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-definition\">\r\n    <div class=\"box-label\">\ud83d\udcd6 Explanation (1) \u2014 'Government Dues' includes:<\/div>\r\n    \r\n    <p><strong>(a) Dues Pertaining to Government Accommodation:<\/strong><\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83c\udfe0<\/span><span>Arrears of licence fee<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Damages for occupation of Government accommodation beyond the permissible period after retirement, if any<\/span><\/li>\r\n    <\/ul>\r\n\r\n    <p style=\"margin-top:12px;\"><strong>(b) Other Dues:<\/strong><\/p>\r\n    <ul class=\"icon-list\" style=\"margin-top:8px;\">\r\n      <li><span class=\"ico\">\ud83c\udfd7\ufe0f<\/span><span>Balance of house building or conveyance or any other advance<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb5<\/span><span>Overpayment of pay and allowances or leave salary<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb3<\/span><span>Arrears of income tax deductible at source under the Income Tax Act, 1961<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u26a0\ufe0f Explanation (2) \u2014 Limitation on Recovery<\/div>\r\n    <p>Only the Government dues as referred to in Explanation (1) shall be adjusted against retirement gratuity. Any other dues which are <strong>not Government dues<\/strong> in terms of Explanation (1) shall <strong>not be recoverable<\/strong> from the amount of retirement gratuity.<\/p>\r\n  <\/div>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 46 -->\r\n  <div class=\"rule-heading-block\" id=\"r46\">\r\n    <span class=\"rule-badge\">RULE 46<\/span>\r\n    <h3>Adjustment and Recovery of Dues Pertaining to Government Accommodation<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Intimation from Directorate of Estates<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The Directorate of Estates on receipt of intimation from Head of Office shall scrutinise its records<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>Inform the Head of Office <strong>within two months<\/strong> if any licence fee was recoverable<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>In respect of the period prior to eight months of retirement<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u2705 Presumption if No Intimation<\/div>\r\n    <p>If no intimation is received by the Head of Office by the stipulated date, it shall be <strong>presumed that no licence fee was recoverable<\/strong> in respect of the period preceding eight months of retirement and <strong>no gratuity shall be withheld<\/strong>.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (2) \u2014 Recovery from Pay and Allowances<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The Head of Office shall ensure that licence fee for the next eight months (up to date of retirement) is recovered <strong>every month from the pay and allowances<\/strong> of the allottee<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (3) \u2014 Recovery of Outstanding Licence Fee<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Where Directorate intimates the amount of licence fee recoverable for the period mentioned in sub-rule (1)<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb5<\/span><span>The Head of Office shall ensure recovery in installments from current pay and allowances<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>Where entire amount is not recovered from pay, the balance shall be recovered out of gratuity before payment is authorised<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (4) \u2014 Licence Fee for Permissible Retention Period<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83c\udfe0<\/span><span>The Directorate shall also inform the amount of licence fee for retention of Government accommodation for the permissible period beyond retirement<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The Head of Office shall adjust that amount from gratuity together with the unrecovered licence fee, if any<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (5) \u2014 Withholding 10% if Unable to Determine<\/h4>\r\n\r\n  <div class=\"box-warning\">\r\n    <div class=\"box-label\">\ud83d\udd12 Withholding Provision<\/div>\r\n    <p>Where it is not possible for the Directorate of Estates to determine the outstanding licence fee, that Directorate shall inform the Head of Office that <strong>ten per cent of the gratuity may be withheld<\/strong> pending receipt of further information.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (6) \u2014 Responsibility of Directorate<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>The recovery of licence fee (where not possible to determine) and damages (for occupation beyond permissible period) shall be the responsibility of the <strong>Directorate of Estates<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The withheld amount shall be paid <strong>immediately on production of 'No Demand Certificate'<\/strong> from the Directorate after actual vacation<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <h4>Sub-rule (7) \u2014 Timely Issue of No Demand Certificate<\/h4>\r\n\r\n  <div class=\"box-important\">\r\n    <div class=\"box-label\">\u23f0 Timeline and Interest<\/div>\r\n    <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n      <li><span class=\"ico\">\ud83d\udccb<\/span><span>The Directorate of Estates shall ensure No Demand Certificate is given <strong>within fourteen days<\/strong> from actual vacation<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The allottee shall be entitled to payment of <strong>interest at PPF rate<\/strong> on the excess withheld amount<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udcc5<\/span><span>Interest payable from actual date of vacation up to date of refund<\/span><\/li>\r\n      <li><span class=\"ico\">\ud83d\udce4<\/span><span>Interest payable by Directorate of Estates through concerned Accounts Officer<\/span><\/li>\r\n    <\/ul>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (8) \u2014 Recovery from Dearness Relief<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>Licence fee or damages remaining unpaid after adjustment from withheld amount may be recovered by the Directorate through concerned Accounts Officer<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udeab<\/span><span>From the <strong>dearness relief without the consent of the pensioners<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u23f8\ufe0f<\/span><span>No dearness relief shall be disbursed until full recovery has been made<\/span><\/li>\r\n  <\/ul>\r\n\r\n  <hr class=\"section-divider\">\r\n\r\n  <!-- RULE 47 -->\r\n  <div class=\"rule-heading-block\" id=\"r47\">\r\n    <span class=\"rule-badge\">RULE 47<\/span>\r\n    <h3>Adjustment and Recovery of Dues Other Than Government Accommodation<\/h3>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (1) \u2014 Assessment Timeline<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>For dues other than those pertaining to occupation of Government accommodation (as referred to in clause (b) of Explanation (1) of rule 45)<\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>The Head of Office shall take steps to assess the dues <strong>one year before<\/strong> the date of retirement on superannuation<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span>Or class=\"box-important\">\r\n    <div class=\"box-label\">\u23f0 Assessment Completion<\/div>\r\n    <p>The assessment of Government dues shall be completed by the Head of Office <strong>eight months prior<\/strong> to the date of retirement.<\/p>\r\n  <\/div>\r\n\r\n  <h4>Sub-rule (3) \u2014 Adjustment Against Gratuity<\/h4>\r\n\r\n  <ul class=\"icon-list\">\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The dues as assessed under sub-rule (2)<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Including those dues which come to notice subsequently<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span>Which remain outstanding till the date of retirement<\/span><\/li>\r\n    <li><span class=\"ico\">\u2705<\/span><span>Shall be <strong>adjusted against the amount of retirement gratuity<\/strong> becoming payable<\/span><\/li>\r\n  <\/ul>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n class=\"chapter-heading-block\" id=\"ch7\">\r\n  <span class=\"chapter-badge\">CHAPTER VII<\/span>\r\n  <h2>Determination and Authorisation of the Amount of Death Gratuity in case of Death of Government Servant During Service<\/h2>\r\n<\/div>\r\n\r\n<!-- RULE 48 -->\r\n<div class=\"rule-heading-block\" id=\"r48\">\r\n  <span class=\"rule-badge\">RULE 48<\/span>\r\n  <h3>Obtaining of Claims for Death Gratuity<\/h3>\r\n<\/div>\r\n\r\n<h4>Sub-rule (1) \u2014 Ascertainment Upon Death<\/h4>\r\n\r\n<p>Where the Head of Office has received an intimation about the death of a Government servant while in service, he shall ascertain,\u2014<\/p>\r\n\r\n<p><strong>(a)<\/strong><\/p>\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udccb<\/span><span><strong>(i)<\/strong> if the deceased Government servant had nominated any person or persons to receive the gratuity; and<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udc65<\/span><span><strong>(ii)<\/strong> if the deceased Government servant had not made any nomination or the nomination made does not subsist, the person or persons to whom the gratuity may be payable.<\/span><\/li>\r\n<\/ul>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udcdd<\/span><span><strong>(b)<\/strong> The Head of Office shall, then, address the person concerned in <strong>Form 8<\/strong>, for making a claim in <strong>Form 9<\/strong>.<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (2) \u2014 Government Accommodation Allottees<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83c\udfe0<\/span><span>Where on the date of death, the Government servant was an allottee of Government accommodation<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udce4<\/span><span>The Head of Office shall address the <strong>Directorate of Estates<\/strong> for the issue of <strong>No Demand Certificate<\/strong><\/span><\/li>\r\n  <li><span class=\"ico\">\u2696\ufe0f<\/span><span>In accordance with the provisions of sub-rule (1) of rule 54<\/span><\/li>\r\n<\/ul>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n<!-- RULE 49 -->\r\n<div class=\"rule-heading-block\" id=\"r49\">\r\n  <span class=\"rule-badge\">RULE 49<\/span>\r\n  <h3>Completion of Form 10<\/h3>\r\n<\/div>\r\n\r\n<h4>Sub-rule (1)(a) \u2014 Simultaneous Action and Timeline<\/h4>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\u23f0 One Month Deadline<\/div>\r\n  <p>The Head of Office while taking action to obtain claim or claims from the family in accordance with the provisions of rule 48 shall simultaneously undertake the completion of <strong>Form 10<\/strong> and the work shall be completed within <strong>one month<\/strong> of the date on which intimation regarding the date of death of the Government servant has been received.<\/p>\r\n<\/div>\r\n\r\n<h4>Sub-rule (1)(b) \u2014 Scrutiny of Service Book<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udcda<\/span><span>The Head of Office shall go through the <strong>service book<\/strong> of the deceased Government servant<\/span><\/li>\r\n  <li><span class=\"ico\">\u2705<\/span><span>Satisfy himself as to whether certificates of verifications of service for the <strong>entire service<\/strong> are recorded therein<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (1)(c) \u2014 Unverified Service<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udd0d<\/span><span><strong>(i)<\/strong> If there are any periods of unverified service, the Head of Office shall accept the unverified portion of service as verified on the basis of the available entries in the service book and may rely on any other relevant material to which he may have ready access.<\/span><\/li>\r\n  <li><span class=\"ico\">\u26a0\ufe0f<\/span><span><strong>(ii)<\/strong> While accepting the unverified portion of service, the Head of Office shall ensure that service was <strong>continuous<\/strong> and was not forfeited on account of dismissal, removal or resignation from service, or for participation in strike.<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (2)(a) \u2014 Verification of Emoluments<\/h4>\r\n\r\n<div class=\"box-keypoints\">\r\n  <div class=\"box-label\">\ud83d\udcb0 Emoluments Verification Period<\/div>\r\n  <p>For the purpose of determination of emoluments for death gratuity, the Head of Office shall confine the verification of the correctness of emoluments for a <strong>maximum period of one year<\/strong> preceding the date of death of the Government servant.<\/p>\r\n<\/div>\r\n\r\n<h4>Sub-rule (2)(b) \u2014 Extraordinary Leave Cases<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span>In case the Government servant was on <strong>extraordinary leave<\/strong> on the date of death<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcc5<\/span><span>The correctness of emoluments for a maximum period of one year which he drew <strong>preceding the date of commencement of extraordinary leave<\/strong> shall be verified<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (3) \u2014 Completion Timeline<\/h4>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\u23f0 One Month Completion<\/div>\r\n  <p>The process of determination of qualifying service and qualifying emoluments shall be completed within <strong>one month<\/strong> of the receipt of intimation regarding the date of death of the Government servant and the amount of death gratuity shall also be calculated accordingly.<\/p>\r\n<\/div>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n<!-- RULE 50 -->\r\n<div class=\"rule-heading-block\" id=\"r50\">\r\n  <span class=\"rule-badge\">RULE 50<\/span>\r\n  <h3>Determination of the Amount of Death Gratuity Where Service Records are Incomplete<\/h3>\r\n<\/div>\r\n\r\n<p>Where the service book has not been maintained properly and it is not possible for the Head of Office to accept the unverified portion of service as verified, the Head of Office shall <strong>not wait<\/strong> for the verification of the entire spell of service, and shall determine the amount of death gratuity as follows:\u2014<\/p>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\ud83d\udccb (i) Provisional Death Gratuity<\/div>\r\n  <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n    <li><span class=\"ico\">\ud83d\udcca<\/span><span>If entire service is not capable of being verified and accepted, the amount of death gratuity shall be determined on <strong>provisional basis<\/strong> in accordance with sub-rule (2) of rule 22<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span>On the basis of the length of qualifying service from the continuous spell of <strong>verified and accepted service immediately preceding the date of death<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>Provisional death gratuity shall be authorised to the beneficiaries within <strong>one month<\/strong> of the receipt of intimation of date of death<\/span><\/li>\r\n  <\/ul>\r\n<\/div>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\u2705 (ii) Final Death Gratuity<\/div>\r\n  <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n    <li><span class=\"ico\">\ud83d\udccb<\/span><span>Final amount of gratuity shall be determined by the Head of Office on acceptance and verification of the <strong>entire spell of service<\/strong><\/span><\/li>\r\n    <li><span class=\"ico\">\u23f0<\/span><span>To be done within a period of <strong>six months<\/strong> from the date on which the authority for payment of provisional gratuity was issued<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb0<\/span><span>The balance, if any, becoming payable shall then be authorised to the beneficiaries<\/span><\/li>\r\n  <\/ul>\r\n<\/div>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n<!-- RULE 51 -->\r\n<div class=\"rule-heading-block\" id=\"r51\">\r\n  <span class=\"rule-badge\">RULE 51<\/span>\r\n  <h3>Forwarding the Form 7 and Form 10 to the Accounts Officer<\/h3>\r\n<\/div>\r\n\r\n<h4>Sub-rule (1) \u2014 Documents to be Forwarded<\/h4>\r\n\r\n<p>On receipt of claim or claims, the Head of Office shall complete item 9 of Form 10 and send to the Accounts Officer:<\/p>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udcc4<\/span><span><strong>Form 10<\/strong> in original<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udccb<\/span><span>A covering letter <strong>in Form 7<\/strong><\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcda<\/span><span>Government servant's <strong>service book<\/strong> duly completed up to date<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcce<\/span><span>Any other documents relied upon for verification of service claimed<\/span><\/li>\r\n  <li><span class=\"ico\">\u23f0<\/span><span>This shall be done not later than <strong>one month<\/strong> of the receipt of claim by the Head of Office<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (2) \u2014 Retention of Copy<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udccb<\/span><span>The Head of Office shall retain <strong>one copy<\/strong> of the Form 10 for his office record<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (3) \u2014 Particulars of Government Dues<\/h4>\r\n\r\n<p>The Head of Office shall draw the attention of the Accounts Officer to the following details of Government dues outstanding against the deceased Government servant:\u2014<\/p>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udcb3<\/span><span><strong>(a)<\/strong> Government dues as ascertained and assessed in terms of rule 54 and recoverable out of the gratuity before payment is authorized<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udd12<\/span><span><strong>(b)<\/strong> Amount of gratuity to be held over partly for adjustment of Government dues not yet assessed, and partly as margin for adjustment in light of final determination<\/span><\/li>\r\n<\/ul>\r\n\r\n<div class=\"box-warning\">\r\n  <div class=\"box-label\">\u26a0\ufe0f Maximum Amount to be Withheld<\/div>\r\n  <p><strong>(c)<\/strong> The maximum amount of gratuity to be held over for the purpose of clause (b) shall be limited to <strong>ten per cent.<\/strong> of the amount of gratuity.<\/p>\r\n<\/div>\r\n\r\n<h4>Sub-rule (4) \u2014 When Claims Have Not Been Received<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udce4<\/span><span><strong>(a)<\/strong> Where Form 10 has been completed but claim or claims have not been received from the beneficiary or beneficiaries, the Head of Office shall forward Form 10 and documents to the Accounts Officer <strong>without the claim or claims<\/strong><\/span><\/li>\r\n  <li><span class=\"ico\">\u26a1<\/span><span><strong>(b)<\/strong> As soon as the claim or claims are received by the Head of Office, they shall <strong>immediately be forwarded<\/strong> to the Accounts Officer<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (5) \u2014 When Government Dues Have Not Been Assessed<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udcdd<\/span><span><strong>(a)<\/strong> Where Form 10 has been completed but Government dues to be recovered have not been assessed, the Head of Office shall forward Form 10 to the Accounts Officer <strong>leaving unfilled item 9 of Part I<\/strong> of the said Form<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udce4<\/span><span><strong>(b)<\/strong> As soon as the Head of Office assesses Government dues, they shall <strong>immediately be forwarded<\/strong> to the Accounts Officer with a request that item 9 of Part I of Form 10 may be filled<\/span><\/li>\r\n<\/ul>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n<!-- RULE 52 -->\r\n<div class=\"rule-heading-block\" id=\"r52\">\r\n  <span class=\"rule-badge\">RULE 52<\/span>\r\n  <h3>Sanction, Drawal and Disbursement of Provisional Death Gratuity<\/h3>\r\n<\/div>\r\n\r\n<h4>Sub-rule (1) \u2014 Procedure for Head of Office<\/h4>\r\n\r\n<p>After the documents referred to in rule 51 have been sent to the Accounts Officer, the Head of Office shall draw <strong>hundred per cent.<\/strong> of the gratuity adopting the following procedure:\u2014<\/p>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udcdd<\/span><span><strong>(a)<\/strong> Issue a <strong>sanction letter<\/strong> in favour of claimant or claimants, endorsing a copy to the Accounts Officer, indicating the amount of hundred per cent. of the gratuity as determined<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcb3<\/span><span><strong>(b)<\/strong> Indicate in the sanction letter the amount <strong>recoverable out of the gratuity<\/strong> under sub-rule (3) of rule 51<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcb0<\/span><span><strong>(c)<\/strong> After issue of the sanction letter, draw by preferring a bill to the Pay and Accounts Officer for hundred per cent. of the gratuity <strong>after deducting the dues<\/strong> mentioned in clause (b)<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (2) \u2014 Immediate Disbursement<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\u26a1<\/span><span>The Head of Office shall <strong>disburse the gratuity immediately<\/strong> after the same have been drawn under sub-rule (1)<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (3) \u2014 Intimation to Accounts Officer<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udce4<\/span><span>The Head of Office shall <strong>inform the Accounts Officer<\/strong> as soon as the gratuity has been paid to the claimant or claimants<\/span><\/li>\r\n<\/ul>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n<!-- RULE 53 -->\r\n<div class=\"rule-heading-block\" id=\"r53\">\r\n  <span class=\"rule-badge\">RULE 53<\/span>\r\n  <h3>Authorisation of Balance of the Death Gratuity by the Accounts Officer<\/h3>\r\n<\/div>\r\n\r\n<h4>Sub-rule (1) \u2014 Processing by Accounts Officer<\/h4>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\u23f0 One Month Processing<\/div>\r\n  <p>On receipt of the documents referred to in sub-rule (1) of rule 51, the Accounts Officer shall, within a period of <strong>one month<\/strong> from the date of receipt apply the requisite checks, complete Section I of Part II of Form 10 and assess the amount of gratuity.<\/p>\r\n<\/div>\r\n\r\n<h4>Sub-rule (2) \u2014 Determination and Disbursement of Balance<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udcca<\/span><span><strong>(a)<\/strong> The Accounts Officer shall determine the amount of the <strong>balance of gratuity<\/strong> after adjusting the amount, if any, outstanding against the deceased Government servant<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udce4<\/span><span><strong>(b)<\/strong> The Accounts Officer shall intimate the amount of the balance to the Head of Office with remarks that the amount may be drawn and disbursed to the person or persons to whom the provisional gratuity was paid<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83c\udfe0<\/span><span><strong>(c)<\/strong> The amount of gratuity withheld under clause (b) of sub-rule (1) of rule 54 shall be adjusted by the Head of Office against outstanding licence-fee under clause (viii) of sub-rule (1) of rule 54, and the balance, if any, refunded<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcb0<\/span><span><strong>(d)<\/strong> The amount of the balance of gratuity may be drawn by preferring a bill to Pay and Accounts Officer and disbursed by the Head of Office<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (3) \u2014 Excess Payment Protection<\/h4>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\ud83d\udca1 Important \u2014 Excess Payment Protection<\/div>\r\n  <p><strong>(a)<\/strong> If the amount of gratuity disbursed by the Head of Office proves to be larger than the amount finally assessed by the Accounts Officer, the beneficiary shall <strong>not be required to refund the excess<\/strong>.<\/p>\r\n  <p style=\"margin-top:10px;\"><strong>(b)<\/strong> The Head of Office shall ensure that chances of disbursing gratuity in excess of the amount actually admissible are minimised and the official or officials responsible for excess payment shall be <strong>accountable for the overpayment<\/strong>.<\/p>\r\n<\/div>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n<!-- RULE 54 -->\r\n<div class=\"rule-heading-block\" id=\"r54\">\r\n  <span class=\"rule-badge\">RULE 54<\/span>\r\n  <h3>Adjustment of Government Dues<\/h3>\r\n<\/div>\r\n\r\n<h4>Sub-rule (1) \u2014 Dues Pertaining to Government Accommodation<\/h4>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\u23f0 Seven Days \u2014 Write to Directorate of Estates<\/div>\r\n  <p><strong>(i)<\/strong> Where on the date of death the Government servant was allottee of Government accommodation, the Head of Office shall within <strong>seven days<\/strong> of the receipt of intimation write to the Directorate of Estates for the issue of <strong>'No Demand Certificate'<\/strong> and shall submit the following information in duplicate (one copy to Rent Wing, second to Allotment Wing):\u2014<\/p>\r\n<\/div>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udc64<\/span><span><strong>(a)<\/strong> Name of the deceased Government servant with designation<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83c\udfe0<\/span><span><strong>(b)<\/strong> Particulars of the accommodation (quarter No., type and locality)<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcc5<\/span><span><strong>(c)<\/strong> Date of death of Government servant<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83c\udfd6\ufe0f<\/span><span><strong>(d)<\/strong> Whether the Government servant was on leave at the time of his death and, if so, the period and nature of leave<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83c\udfd8\ufe0f<\/span><span><strong>(e)<\/strong> Whether the Government servant was enjoying rent-free accommodation<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcb0<\/span><span><strong>(f)<\/strong> The period up to which licence fee had been recovered, the monthly rate of recovery and particulars of the pay bill under which last recovery was made<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udccb<\/span><span><strong>(g)<\/strong> If the licence fee had not been recovered up to the date of death and the family intends to retain Government accommodation for the permissible period, details of:\u2014<\/span><\/li>\r\n<\/ul>\r\n\r\n<div class=\"box-keypoints\">\r\n  <div class=\"box-label\">\ud83d\udcca Details to be Provided under (g)<\/div>\r\n  <ul class=\"icon-list\" style=\"margin-top:10px;\">\r\n    <li><span class=\"ico\">\ud83d\udcc5<\/span><span><strong>(A)<\/strong> Period for which licence fee still remains to be recovered<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb5<\/span><span><strong>(B)<\/strong> Amount of licence fee in respect of the period in (A) determined on the basis of standard rent bill<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83c\udfe0<\/span><span><strong>(C)<\/strong> Amount of licence fee for retention of Government accommodation by the family for the concessional period of <strong>four months<\/strong> beyond the date of death, on the basis of standard bill<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcb3<\/span><span><strong>(D)<\/strong> Amount of licence fee mentioned in (B) and (C) proposed to be recovered out of the death gratuity<\/span><\/li>\r\n    <li><span class=\"ico\">\ud83d\udcc4<\/span><span><strong>(E)<\/strong> Details of any previous reference from the Directorate of Estates having bearing on the recovery of licence fee outstanding against the allottee and action taken thereon<\/span><\/li>\r\n  <\/ul>\r\n<\/div>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udcb0<\/span><span><strong>(ii)<\/strong> The Head of Office shall <strong>recover from the death gratuity<\/strong> the amount of licence fee as intimated to the Directorate of Estates under clause (i)<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83c\udfe2<\/span><span><strong>(iii)<\/strong> The recovery of licence fee for occupation of Government accommodation <strong>beyond a period of four months<\/strong> shall be the responsibility of the <strong>Directorate of Estates<\/strong><\/span><\/li>\r\n<\/ul>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\u23f0 Two Months \u2014 Directorate of Estates to Communicate<\/div>\r\n  <p><strong>(iv)<\/strong> The Directorate of Estates shall scrutinise their records to determine if any other licence fee was outstanding and shall communicate the amount and period(s) to the Head of Office within <strong>two months<\/strong> of the receipt of intimation under clause (i).<\/p>\r\n<\/div>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udd12<\/span><span><strong>(v)<\/strong> After receipt of information under clause (iv), the Head of Office shall withhold the <strong>amount as intimated by the Directorate of Estates<\/strong>, or <strong>ten per cent. of the death gratuity<\/strong> in case no specified amount is intimated<\/span><\/li>\r\n<\/ul>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\u2705 Presumption if No Intimation Received<\/div>\r\n  <p><strong>(vi)<\/strong> Where no intimation is received by the Head of Office within the period specified under clause (iv), it shall be <strong>presumed that nothing was recoverable<\/strong> from the deceased Government servant and the amount of gratuity withheld shall be paid to the beneficiaries.<\/p>\r\n<\/div>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udd0d<\/span><span><strong>(vii)<\/strong> Where intimation is received from the Directorate of Estates regarding outstanding licence fee, the Head of Office shall verify from acquittance rolls if the outstanding amount had already been recovered from pay and allowances \u2014 if so, draw the attention of the Directorate to the relevant pay bills and pay the withheld amount to the beneficiaries<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udcb3<\/span><span><strong>(viii)<\/strong> Where the outstanding licence fee was <strong>not<\/strong> recovered from pay and allowances, the outstanding amount shall be adjusted against the gratuity withheld under clause (v) and the balance, if any, repaid to the beneficiaries<\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (2) \u2014 Dues Other Than Government Accommodation<\/h4>\r\n\r\n<div class=\"box-important\">\r\n  <div class=\"box-label\">\u23f0 One Month \u2014 Assessment of Other Dues<\/div>\r\n  <p>The Head of Office shall, within <strong>one month<\/strong> of the receipt of intimation regarding death of a Government servant take steps to ascertain if any dues as referred to in rule 47 (excluding dues pertaining to Government accommodation) were recoverable from the deceased Government servant, and such ascertainable dues shall be <strong>recovered from the amount of death gratuity<\/strong> becoming payable to the family.<\/p>\r\n<\/div>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n<!-- RULE 55 -->\r\n<div class=\"rule-heading-block\" id=\"r55\">\r\n  <span class=\"rule-badge\">RULE 55<\/span>\r\n  <h3>Payment of Death Gratuity When a Government Servant Dies While on Deputation<\/h3>\r\n<\/div>\r\n\r\n<h4>Sub-rule (1) \u2014 Deputation to Another Central Government Department<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83d\udd04<\/span><span>In case of a Government servant who dies while on deputation to another Central Government Department<\/span><\/li>\r\n  <li><span class=\"ico\">\ud83d\udc54<\/span><span>Action to authorise death gratuity shall be taken by the <strong>Head of Office of the borrowing Department<\/strong><\/span><\/li>\r\n<\/ul>\r\n\r\n<h4>Sub-rule (2) \u2014 Deputation to State Government or Foreign Service<\/h4>\r\n\r\n<ul class=\"icon-list\">\r\n  <li><span class=\"ico\">\ud83c\udf0d<\/span><span>In case of a Government servant who dies while on deputation to a State Government or while on foreign service<\/span><\/li>\r\n  <li><span class=\"ico\">\u2696\ufe0f<\/span><span>Action shall be taken by the <strong>Head of Office or the cadre authority<\/strong> which sanctioned the deputation<\/span><\/li>\r\n<\/ul>\r\n\r\n<hr class=\"section-divider\">\r\n\r\n<!-- class=\"ico\">\ud83c\uddee\ud83c\uddf3<\/span><span>The gratuity admissible under these rules shall be payable in <strong>rupees in India only<\/strong><\/span><\/li>\r\n<\/ul>\r\n\r\n<hr
